NC as requested in the permittee's application, dated 02/24/05. This permit, issued on March 28, 2005, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes'set forth below. Any violation of these terms may subject permittee to a tine, imprisonment or civil action, or may cause the permit to De nun ana voia. This permit authorizes a 5,500 sq.' LEED certified building yvhich will house a small lecture hall, a teaching laboratory, and a student commons area. Any other development will require additional permits or a modification of this permit. The following conditions shall apply: 1. All proposed development and associated construction must be done in accordance with the application dated 02/11/05, workplat drawing(s) dated 12/15/04, and originally submitted on 02/11/05. 2. All construction must conform to the North Carolina Building Code requirements and all other Local, State and Federal regulations. 3. Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. 4. The amount of impervious surface areas shall not exceed 30% of the lot area within 75' of the normal high water contour/normal water contour, which defines the Coastal Shoreline AEC at this location. In this case, 1705 sf of impervious surface is authorized. Conditions continued on second nape This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From. the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2008. In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This permit may not be transferred to another party without the written approval of the Division of Coastal Management. The site for development is a 43,540 square feet potion of the south east side of Piver's Island. The building planned for construction is the Ocean Science Teaching Center, a 5,500 square foot LEED Certified building which will house a small lecture hall, a teaching laboratory, and a student commons area. Of the total 5,500 square feet of building, 1,705 square feet of building and porch will be in the 75' AEC setback. A few things which are noted on the permit, but I wanted to bring to your attention are: • The site is bulkheaded and therefore has no dunes and the first line of vegetation is at the bulkhead. • The Duke Marine Lab portion of Pivers Island made up of three Deed Book Entries: Book 89, page 107; Book 81, page 132; Book 81, page 133. Based on our meeting a couple of weeks ago, sounds like this is the 3rd scenario we discussed where the Repass Center is "in" and the cumulative impervious for Repass and the new Lab Building is over 10,000. The cumulative land disturbance for the proposed lab building is just under one acre, so I'm sure the cumulative disturbance for the two projects is over 1 acre. Therefore we're going to need a State SW permit. We will take the impervious for the two projects and re -do the boundary as low -density. For the more detailed information from Rhonda on the Repass CAMA permit, is this something you guys get or do we need to chase that down? This requirement came into being in 1995. The DWQ can require an individual project that disturbs <1 acre or does not require a CAMA Major permit to obtain a stormwater permit, if it's part of a larger common plan of development. I believe we can make the case that the Duke Marine Lab area on Piver's Island is a common plan of development. That being said, the Repass Center was apparently permitted via the CAMA Minor permit process in 2005. 1 do not know what the disturbed area or built -upon area was for that project, but hopefully Ronda Bennett has that information. The next phase (MSCGC) that we discussed last Friday is apparently less than 10,000 square feet of new BUA. I again do not know what the associated disturbed acreage is. In light of the designation as a common plan of development, please be advised that Duke University needs to be in the process of preparing a Master Plan for eventual approval and permitting by the Division of Water Quality. However, at this time, if the total cumulative disturbed acreage, beginning in 2005 with the Repass CAMA Minor and ending with the current proposed MSCGC project, is greater than 1 acre, then a stormwater permit will be required prior to construction of the MSCGC. If the total cumulative disturbed acreage since the 2005 Repass Center has not yet reached 1 acre, then a stormwater permit will not be required until either of the following occurs: 1. A project is proposed in that area that will cause the cumulative amount of disturbed area to exceed one acre; 2. A project is proposed in that area that requires a CAMA Major permit. 3. A project is proposed that cumulatively exceeds 10,000 sf of new BUA. Since the MSCGC was close to 10,000 sf itself, the next project will most likely put it over 10,000.
