Issued to Pete Deichmann authorizing development in Atlantic Beach Estuarine Shoreline at 537 N. Kinston Ave. Carteret County as requested in the permittee's application, dated 2/14/05 This permit, issued on 2/28/05 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes setforth below. Anyviolation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. ✓ 4.1* 05-13 Permit Number This is a permit authorizing the replacement of a 338 sq. ft. open deck located approximately 21' landward of the normal high water mark located at 537 N. Kinston Ave. Any other development will require additional permits or a modification of this permit. The following conditions shall apply: All proposed development and associated construction must be done in accordance with the permitted workplat drawing as submitted, stamped and received on February 14, 2005. This permit does not authorize an increase in impervious surface area. The replacement of this deck is authorized by section 15A NCAC 07J.0211, Non -Conforming Development, which states that replacement of a non -conforming structures shall be allowed when all of the following criteria are met: 1. the structure will not be enlarged beyond its original dimensions, 2. the structure will serve the same or similar use, 3. there are no practical alternatives for replacing the structure to provide the same or similar benefits in compliance with current rules, and 4. the structure will be rebuilt so as to comply with current rules to the maximum extent possible. This permit authorizes 299 sq. ft. of open decking within the 30' buffer. All construction must conform to the N.C. Building Code requirements and all other Local, State and Federal regulations, Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. In order to prevent sedimentation, a vegetated buffer zone must be maintained between all disturbed areas and the adjacent water body or marsh. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales or burlap must be installed between the land -disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetated cover. Pursuant to 15 NCAC, Subchapter 7J.0406(b)r,this permit may not be assigned, transferred, sold or otherwise disposed This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit must cease until the appeal is resolved. The deadline for making a permit decision is March 11, 2005. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be notified. I acknowledge that the local permit officer has explained to me the particular hazard problems associated with this lot. This explanation was accompanied by recommendations concerning stabilization and floodproofing techniques.
