ACM /Mhd City 05-01 Permit Number Local Government LAMA MINOR DEVELOPMENT PERMIT �~ as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statues, "Coastal Area Management" Issued to Conscience Bay. LLC dba Town Creek Marina , authorizing development. in Estuarine Shoreline AEC at 232 West Beaufort Rd., Beaufort as requested in the permittee's application, dated Jan. 24, 2005. This permit, issued on February 7, 2005, is subject to compliance with -the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes the location of a 12' X44' modular commercial office building within the high ground area adjacent to Town Creek, contingent upon the following rules: (1) All portions of the building must be located a minimum of 30' from the NHW contour line. (2) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received Jan. 24, 2005. (3) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (4) Any change or changes in the plans for development, construction, or land use activities will require a re- evaluation and modification of this permit. (5) Prior to initiating any land -disturbing activities, adequate sedimentation/erosion control measures must be employed to prevent the movement of unconsolidated materials into the marsh or water. These measures will remain in place until such time as the area has been properly stabilized with a vegetated cover. See Page 2 for additional conditions This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2008 . In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Revised Previous Revised April, 2002 Suggested Minor Permit and Exemption Conditions for typical scenarios: General Coastal Shoreline Conditions: This permit authorizes . Any other development will require additional permits or a modification of this permit. The following conditions shall apply: 1) All proposed development and associated construction must be done in accordance with the application dated , work plat drawings dated , and originally submitted on , or as revised on 2) All construction must conform to the NC Building Code requirements and all Local, State, and Federal regulations. 3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. 4) The amount of impervious surface areas shall not exceed 30% of the lot area within 75' of the normal high water contour/normal water contour, which defines the Coastal Shoreline AEC at this location. In this case, sf of impervious surface is authorized. 5) Prior to initiating land -disturbing activities, adequate sedimentation/erosion control measures must be employed to prevent the movement of unconsolidated materials into the marsh or water. These measures must remain in place until such time as the area is properly stabilized with vegetated cover. 6) The applicant has effectively demonstrated, through engineered, innovative construction design, that the amount of impervious surface areas may be exceeded in a way that runoff water will be managed to a similar degree as limiting the coverage to 30%. This design allows for _% of impervious surface area within the AEC of this project site. The submitted design was done by , submitted on , and is dated 7) .The innovative stormwater system authorized with this permit must be maintained for the life of the structure addressed. 8) Pursuant to 15A NCAC 07J .0406(b), this permit may not be assigned, transferred, sold, or otherwise disposed of to a third party by the applicant, agent, or any entity other than the NC Division of Coastal Management. Page 02 9) It is noted that coastal marsh exists on the property, and that the proposed development addressed on the submitted plat dated is not located within this marsh. 10) It is noted that there are federal wetlands on this property, as delineated by/shown on the plat dated , and that the proposed development addressed on the submitted plat dated is not located within these wetlands. 11) No excavation or filling of any wetlands or waters is authorized under this permit. 12) The development authorized under this permit must be accomplished a minimum of 30' landward of the normal high water contour/normal water contour, maintaining this as a vegetated buffer area. 13) The area proposed for grading within the 30' buffer from the normal high water contour/normal water contour must immediately be vegetatively stabilized, and must remain in a vegetated state. 14) This proposal meets the exception to the buffer as addressed in 15A NCAC 07H .0209(e), and as such, the footprint of the authorized structure is sf. 15) This proposal meets the exception to the buffer as addressed in 15A NCAC 07H .0209(e), and as such, all land disturbance is limited to that necessary to construct and provide access to the residence and allow for installation of utilities. 16) This proposal meets the exception to the buffer as addressed in 15A NCAC 07H .0209(e), and as such, all non -water dependent development shall be located a minimum of _ feet landward of the normal high water contour/normal water contour. 17) Any development or land disturbing activity that is considered non -water dependent is not authorized within 50 feet of the normal high/normal water level unless specifically exempted by Environmental Management Commission (EMC) Tar Pamlico/Neuse River buffer regulations in place at the time of such development. 18) A copy of this permit shall be available onsite for regulatory inspection. 19) This authorization allows for the demolition/relocation of the existing structure. All associated debris must be properly disposed of and the site returned to pre -development condition. Additional conditions for residential Letters of Exemption: This Letter of Exemption authorizes . Any other development will require additional authorizations. The following conditions shall apply: Page 03 20) All development, to include the structure.and all associated ground disturbing activity must be located a minimum of 40' landward of the normal high water contour/normal water contour. Additional conditions for shorelines adjacent to ORW waters: 21) The development authorized under this permit must be accomplished a minimum of 30' landward of the normal high water contour/normal water contour, maintaining this as a vegetated buffer area. 22) The amount of built -upon area shall be limited to no more that 25% of the area within 575' from the normal high water contour/normal water contour, which defines the Coastal Shoreline AEC at this location. In this case, sf of built -upon surface is authorized. 23) Stormwater collection systems are prohibited under this permit, as they are adjacent to all ORW waters. Conditions specific to construction within Ocean Hazard AEC: 24) The structure shall comply with the NC Building Code and all other Federal, State, and Local regulations, including the National Flood Insurance Program. 25) The structure must be set back a minimum of _ feet from the first line of stable natural vegetation, as determined by the DCM or the LPO. 26) The structure must be located entirely off of the frontal dune. 27) The structure must be located behind the crest of the primary dune. 28) The structure must be elevated on pilings with a diameter of at least eight (8) inches and the first floor level of the sills and joists must meet the 100-year flood elevation level of _ feet. 29) All pilings shall have a tip penetration greater than eight (8) feet below the lowest ground elevation under the structure. For those structures so located on the primary dune or nearer to the ocean, the pilings must extend to five (5) feet below mean sea level. 30) No impermeable surfaces shall be allowed over any functional part of the septic tank system. 31) Dune disturbances shall be allowed only to the extent necessary for development and if the dune's protective value is not weakened or reduced. Disturbed areas will be t Page 04 immediately stabilized vegetatively. No development shall involve the significant relocation or removal of primary or frontal dune sand or vegetation thereon. 32) This permit may be renewed for one (1) year if requested before the expiration date. 33) The permittee is required to contact the Local Permit Officer shortly before he plans to begin construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be re-established. 34) Sand used to strengthen dunes must be brought in from an outside source and must be of the same nature as the sand in the area in which it is to be placed. No sand is to be removed from the lot. 35) Adding to dunes shall be accomplished in such a manner that the damage to existing vegetation is minimized. The filled areas will be immediately stabilized vegetatively. 36) Sand held in storage in any dune, other than frontal or primary dunes, may be moved in order to strengthen existing primary or frontal dunes if the work would enhance the protection to the proposed development activity and the sand is immediately stabilized vegetatively. This work must be accomplished landward of the toe of the frontal dune and the crest of the primary dune. 37) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. Conditions specific to construction within the Inlet Hazard AEC: 38) Minimum lot size shall be 15,000 sf for each commercial or residential unit for all parcels of land subdivided or created after July 23, 1981. A duplex can only be constructed on a lot at least 30,000 sf in area, a triplex on 45,000 sf in area, and a quadraplex on 60,000 sf. This permit authorizes a _ sf single family/duplex/ triplex/quadraplex on a lot _ sf in size. 39) Only residential structures of four (4) units or less, or non-residential structures of less that 5,000 sf total floor area, shall be allowed. The development authorized under this permit allows for a _ structure of sf. Page 05 40) Traditional public accessways shall not be eliminated or restricted. Residential exceptions to Ocean Hazard setback only: (not for Inlet Hazard AEC) 41) Applicant qualifies for this exception because the lot was recorder prior to June 1, 1979, and does not meet the setback of _ feet from the first line of stable natural vegetation. 42) This lot was recorder prior to June 1, 1979, and cannot be enlarged by combining it with a contiguous lot(s) under the same ownership. 43) The development is set back as far landward from the first line of stable natural vegetation as possible, such that the.structure is a minimum of 60' landward of this line, and is entirely behind the frontal dune. This permit authorizes a structure that will be set back _ feet from the first line of stable natural vegetation. 44) All pilings shall be at least eight (8) inches in diameter with a tip penetration of four (4) feet below mean sea level. 45) The lowest habitable floor is restricted to 1,000 sf, or 10% of the lot size, whichever is greater. 46) All development addressed in these exceptions must be located landward of the first line of stable, natural vegetation. 47) The development must be accomplished in such a manner as not to alter the integrity of the frontal or primary dunes. Conditions for dune crosswalks: 48) Accessways shall be exclusively for pedestrian use, shall be no more that six (6) feet in width, and shall be elevated on pilings of no more that five (5) feet in depth, and shall be elevated to a height that does not allow the decking to touch the sand. 49) Only negligible alteration of the dunes is allowed during construction and any disturbed areas of vegetation shall be re -vegetated immediately. 50) Unenclosed, uninhabitable gazebos with floor areas of 200 sf or less are permitted. This construction cannot be combined with the allowance for decks addressed in the setback exception standards to create one large structure. Page 06 Conditions for Beach Bulldozing: Statutory Exemption (7K .0103(b)) 51) The structure addressed in this exemption has been deemed imminently threatened for purposes of this authorization. 52) The area on which this activity is being performed must maintain a slope of adequate grade so as not to endanger the public or the public's use of the beach, and should follow the natural slope as closely as possible. The movement of material utilizing a bulldozer, front-end loader, backhoe, scraper, or any type of earth moving equipment shall not exceed one (1) foot in depth measured from the pre -activity surface elevation. 53) The activity must not exceed the lateral bounds of the applicant's property unless he has permission of adjoining landowners. 54) Movement of material from seaward of the low water line will not be permitted_ under this exemption. 55) The activity must riot significantly increase erosion on neighboring properties and must not have a significant adverse effect on important or cultural resources. 56) The authorized activity is being undertaken to protect the structure's waste disposal system. General Permit (7H .1800) 57) This permit allows for the bulldozing needed to repair damage to frontal and/or primary dune systems. 58) All work must occur landward of the mean high water mark. 59) The activity authorized under this General Permit allows for the "push zone," or area within which the sand may be obtained, to extend to _ feet from the existing escarpment/road/foundation/septic tank. 60) The activity authorized under this General Permit allows for the waterward toe of the pushed dune to be located . feet from the existing escarpment/road/foundation/septic tank. 61) The activity must not significantly increase erosion on neighboring properties and must not have a significant adverse effect on important or cultural resources. Page 07 62) The area on which this activity is being performed must maintain a slope of adequate grade so as not to endanger the public or the public's use of the beach, and should follow the natural slope as closely as possible. The movement of material utilizing a bulldozer, front-end loader, backhoe, scraper, or any type of earth moving equipment shall not exceed one (1) foot in depth measured from the pre -activity surface elevation. 63) The activity must not exceed the lateral bounds of the applicant's property unless he has permission of adjoining landowners. 64) Future setback determinations that may be required shall be made using the first line of stable natural vegetation established prior to the bulldozing activity. 65) No bulldozing shall occur between the time period of May 01 through November 15 of any year without prior approval of the DCM in coordination with the WRC, the US ACE, and the US F&W Service. Conditions for Sandbags: 66) This permit authorizes sandbag placement for the purpose of temporary erosion control of an imminently threatened structure. 67) The authorized temporary structure shall be limited to sandbags placed landward of the mean high water mark and parallel to shore. 68) The activity authorized in this permit is being undertaken to protect the structure's waste disposal system. 69) This permit authorizes sandbags located such that the landward side of the temporary erosion control structure is located _ feet from the foundation of the structure/septic system. 70) This permit authorizes sandbags located such that the waterward side of the temporary erosion control structure is located _ feet from the foundation of the structure/septic system. 71) The base width of the temporary erosion control structure shall not exceed twenty (20) feet in width. 72) The height of the temporary erosion control structure shall not exceed six (6) feet. 73) The temporary erosion control structure may remain in place for the length of time appropriate under 15A NCAC 07H .1705(a)(7). Page 08 74) Once the temporary erosion control structure is deemed unnecessary due to relocation or removal of the threatened structure or beach renourishment, it must be removed in its entirety. This rule shall not apply if the bags remain covered with sand and vegetated sufficiently to be considered stable, natural, vegetation. 75) Sandbags used to construct temporary erosion control structures shall be tan in color, three (3) to five (5) feet wide, and seven (7) to fifteen (15) feet long when measured flat. 76) Soldier pilings and other anchor type devices shall not be allowed. 77) An imminently threatened structure may only be protected once regardless of ownership, however in increments if necessary. Conditions for Sand Fences: Exemption: (07K .0212) 78) Sand fences must not exceed 5' in height. 79) Sand fences must be constructed of evenly spaced, thin vertical slats connected with twisted wire, stabilized with 2" x 4" stakes, or posts with a diameter not to exceed 3". 80) Sand Fences must be placed as far landward as possible to avoid impeding turtle activity and public traffic. 81) This authorization is for fencing parallel to the shoreline, not to be located waterward of the crest of the dune. 82) This authorization is for the fencing to be placed at 45' angles to the shoreline, waterward of the crest of the dune, not to exceed 10' in length. Sections must be spaced at least 7' apart. 83) In no case may the fencing exceed 10' beyond the furthest of the following: the first line of stable, natural, vegetation; the toe of the frontal or primary dune; the erosion escarpment of the dune. 84) Non-functioning, damaged, or unsecured sand fencing shall be immediately removed by the property owner. 85) In no case shall sand fencing be located or placed on wet sand beach. Page 09 Minor Permit: (07H .0311) 86) The placement of the sand fence shall not impede public access to the beach, the recreational use of the beach, emergency vehicular access to or along the beach, nor restrict common law and statutory rights of public access and use of public trust lands and waters. 87) Sand fences must not interfere with or endanger in any manner sea turtles, sea turtle nests, sea turtle hatchlings, or any other threatened or endangered species. This application has been reviewed by the NC Wildlife Resources Commission and the US Fish and Wildlife Service and has been deemed to have insignificant impacts to the above resources, based on the plat dated _ and submitted on _ 88) Non-functioning, damaged, or unsecured sand fencing shall be immediately removed by the property owner. 89) In no case shall sand fencing be located or placed on wet sand beach.
