Issued to William & Vickie Coley authorizing development in Atlantic Beach Estuarine Shoreline at 209 Smith St. Carteret County as requested in the permittee's application, dated 8/10/05 This permit, issued on 8/29/05 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This is a permit authorizing the construction of a single family dwelling located 30' landward of the normal high water mark located at 209 Smith St. Any other development will require additional permits or a modification of this permit. The following conditions shall apply: All proposed development and associated construction must be done in accordance with the permitted workplat drawing as submitted, stamped and received on August 10, 2005. The 30' buffer noted on the workplat drawing must be measured from the normal high water mark to the overhang of the principle dwelling. Only up to 200 sq. ft. of open decking is allowed in the 30' buffer. This permit also authorizes the renovation of the shop building on an existing concrete slab within the 30' buffer. The amount of impervious surface area shall not exceed 30% of the lot area within 75' of the normal high water mark, which defines the Coastal Shoreline AEC at this location. In this case, 1,323 sq. ft. of impervious surface is authorized on the condition of the removal of 95 sq. ft. of the existing concrete driveway within the AEC. All construction must conform to the N.C. Building Code requirements and all other Local, State and Federal regulations.1 Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. In order to prevent sedimentation, a vegetated buffer zone must be maintained between all disturbed areas and the adjacent water body or marsh. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales or burlap must be installed between the land -disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetated cover. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31. 2008 - In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This permit may not be transferred to another party without the written approval of the Division of Coastal Management.
