No portion of the roof overhang shall encroach waterward of NHW. (6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (7) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional stormwater runoff to the adjacent marsh. (10) The; applicant has effectively demonstrated, through innovative construction design, that the amount of impervious surface areas may be exceeded in a way that runoff water will be managed and the AEC protected, so as to allow 0 percent of imperious areas within the 75' Coastal Shoreline AEC. All proposed development and associated construction must be done in accordance with the design specifications of the permitted innovative design, sealed by the design professional, Steven Jenoski, on 10/29/05. (11) Upon completion of construction and prior to the issuance of a Certificate of Occupancy (CO), a letter of certification must be received from the designer of the innovative system installed, certifying that the permitted system has been installed in accordance with this permit, the approved plans and his design specifications. Any deviations from the approved plans and specifications must be noted on the Certification and a permit modification may be required prior to receiving a CO. (12) The landowner or permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The landowner or permittee shall maintain the permitted stormwater system for the life of the project. (13) All work must be constructed in accordance with Certificate of Appropriateness from the Town of Beaufort Historic Preservation Commission dated rch 10, 2005. Ross Jr., Secretary "IW4 S� This letter confirms our recent telephone conversation regarding the Beaufort Historic Preservation Commission's review of a development project at 324 Front Street, adjacent to Taylor's Creek, in the Town of Beaufort, Carteret County, North Carolina. The purpose of our conversation was to discuss the protocol to be followed in applying for a- CAMA Minor Permit in the Town of Beaufort's Historic District. Several weeks ago I wrote a letter to Mr. Carl Meares, owner of the property at 324 Front Street, recommending that he speak with representatives from the Town of Beaufort to ensure that his proposal would be found consistent with the Town's zoning ordinance in particular with the zoning ordinance of the Historic District. I told him that I felt it critical that he obtain the Town's Certificate of Appropriateness before applying for the CAMA Minor Permit. I now recognize that this is probably not appropriate in this case since the development that Mr. Meares proposed would require a stormwater management system (to be designed by a licensed individual to meet or exceed the protection provided by the 30 % rule) that must be approved by the Division during the Minor permitting process. This protocol of processing the Minor Permit application first would allow the Historic Preservation Commission to the review the final location and design for appropriateness of structures including those associated with any "approved" stormwater management system. Such a process described above appears to be consistent with the guidelines established by the Historic Preservation Commission. I will certainly direct staff to follow this protocol to ensure consistent processing of CAMA Minor permit applications. The original site is outlined with wood decking and is established for the sell of waterfront boat tours and rental of kayaks. The residence site is adjacent to an existing gift shop on the same lot. The gift shop will be remodeled to remove approximately 12 feet of the rear of the building and replace it with a patio. The existing facilities will not increase the amount of impervious area on the site, however, the proposed residence will increase the impervious area from 0% (does not include wood decking) to 100% for the construction of the residence. The construction of this building is within the CAMA AEC and is required to provide the same protection to the receiving water as -was previously provided by the area within the AEC. The building roof constitutes 100% of the drainage area for this portion of the lot. A storm drainage system is proposed and designed to capture and infiltrate in the ground the first 1.5 inches of runoff. The runoff in excess of the 1.5 inches of runoff will discharge through a storm water treatment basin manufactured by Hydro International that • will remove 80% of the total suspended solids prior to discharging into and existing Beaufort storm drainage pipe that releases runoff into Taylor's Creek. Typically a 30 foot or 50 foot grassed swale .is constructed at the end of an infiltration trench prior to discharging into the receiving waters. This is not practical on this urban waterfront property and the storm water treatment basin is proposed in its place. The BMP manual states that a grass swale will remove 35% of total suspended. The Hydro International Downstream Defender is designed to remove 80% total suspended solids. The first 1.5 inches of runoff is collected in a drainage system and discharged into a infiltration trench beneath the proposed brick pavers. The infiltration trench will consist of a washed #57 stone with a minimum depth of 1.5 feet. Roof drainage is collected and discharge into an infiltration system. When the first 1.5 inches of runoff is stored the excess runoff is discharged through the "Downstream Defender" prior to discharging. into the existing collection system. The invert of the drainage system is at elevation 3.67 with the bottom of the infiltration trench elevation at 3.5. The seasonal high water table is approximately 1.5 as determined by Terracon Consultants. They performed a permeability test on a composite sample of four borings and determined the average rate to be 1.0 inches per hour. This is greater than the permeability of 0.52 in/hr minimum recommended by the BMP manual.
