Bailey, Jr., authorizing development in the Estuarine Shoreline (AEC) at lot 14 Anchorage Marina, in Atlantic Beach, N.C., as requested in the permittee's application, dated December 12, 2005. This permit, issued on December 22, 2005, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes the replacement of the mobile home located within the 75' Area of Environmental Concern. The proposed mobile home is smaller than, the existing mobile home and has the same amount of impervious coverage within the 30' buffer as the existing one. This permit does not authorize an increase in impervious coverage within the 75' AEC. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawing stamped and received on December 12, 2005. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at (252) 726-4456 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2008 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (6) Any proposed area for grading within the 30' buffer from the normal high watermark must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (7) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
