Dear Mr. Sneed:
After reviewing your application in conjunction with the development standards required by the
Coastal Area Management Act (CAMA) and our locally adopted Land Use Plan and Ordinances,
it is my determination that no permit may be granted for the project you have proposed.
This decision is based on my finding that your request violates NCGS 113A-120(8), which
requires that all applications be denied which are inconsistent with CAMA guidelines. You have
applied to construct a three thousand four hundred and fifty-six square foot, two-story duplex
which would be located seaward of the erosion setback line, (the area which is sixty feet
landward from.the first line of stable natural vegetation), which is inconsistent with 15 NCAC
7H.0306(a)(1) which states "If neither a primary nor frontal dune exists in the AEC on or landward
of the lot on which the development is proposed, the development shall be landward of the
erosion setback line. The erosion setback line shall be set at a distance of thirty times the long
term annual erosion rate from the first line of stable natural vegetation or measurement line,
where applicable. In areas where the rate is less than two feet per year, the setback line shall be
sixty feet from the vegetation line or measurement line, where applicable."
I have enclosed the appropriate forms should you wish to appeal this decision. Appeal notices
must. be received by the Division of Coastal Management in Raleigh within twenty days of the
date of this letter in order to be considered.

Dear Mr. Sneed:
The N.C. Division of Coastal Management hereby acknowledges receipt of your application for
State approval for minor development of your property located at 400 Glenn St., Atlantic Beach in
Carteret County. It was received complete on September 8, 2004 and appears to be adequate
for processing at this time. The deadline for making a permit decision is October 3, 2004.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development_ Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development_ You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result In an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be notified.

Pursuant to NCGS 113A-119(b), the Town of Atlantic Beach, a locality authorized to issue
CAMA Permits in areas of environmental concern, hereby gives notice that on September
8, 2004, Henry M. Sneed applied for a CAMA Permit to construct a duplex located at 400

Public comments received by September 20, 2004 will be considered. Later comments will
