Issued to William Lambeth authorizing development in Atlantic Beach Estuarine Shoreline at unit 76 at 82 Marina Village Carteret County as requested in the permittee's application, dated 11/12/04 This permit, issued on 11/12/04 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. 04-32 Permit Number This is a modification to the existing permit authorizing the enclosure of.the garage area and the enlargement the existing deck by 1'/Z' located 34' landward of the normal high water mark to also include construction of a 10' x 13' open deck located 63' landward of the normal high water mark located at unit 76 8'/2 Marina Village. Any other development will require additional permits or a modification of this permit. The following conditioi shall apply: All proposed development_ and associated construction must be done in accordance with the permitted workplat drawing as submitted, stamped and received on September 14, 2004 and November 12, 2004. This permit does not authorize an increase in impervious surface area and does not authorize additional open decking within the 30' buffer. All construction must conform to the N.C. Building Code requirements and all other Local, State and Federal regulations Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. In order to prevent sedimentation, a vegetated buffer zone must be maintained between all disturbed areas and the adjacent water body or marsh. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales or burlap must be installed between the land -disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetated cover. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third party. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m„st cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31, 2007 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances.
