Issued to A.B. Cooper, Jr. authorizing development in Atlantic Beach Estuarine Shoreline at 111 North Shore MHP Carteret County as requested in the permittee's application, dated 7/09/04 This permit, issued on 7/12/04 . is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This is a modification to the existing permit authorizing the replacement of a mobile home located 20' landward' of the bulkhead located at 111 North Shore MHP. Any other development will require additional permits or a modification of this permit. The following conditions shall apply: All proposed development and associated construction must be done in accordance with the permitted workplat drawn as submitted, stamped and received on June 3, 2004 and modified on July 9, 2004. The size of the new mobile home 14' x 66' (770 sq. ft.) whereas the old mobile home was 12' x 60' (660 sq. ft. within the 75' AEC). This permit authorizf a 110 sq. ft. increase within the 75' AEC as long as the applicant gutters the stormwater outside of the 75' AEC. The guttering of the stormwater outside of the 75' AEC must be in place for as long as this mobile home remains in this Iodation. All construction must conform to the N.C. Building Code requirements and all local, state and federal regulations Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. In order to prevent sedimentation, a vegetated buffer zone must be maintained between all disturbed areas and the adjacent water body or marsh. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales or burlap must be installed between the land -disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetated cover. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third party. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m.st cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance.
