Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. To fall low areas with topsoil. The amount of impervious surface area shall not exceed 30% of the lot area within the 75' of the AEC (area of environmental concern). All proposed development and associated construction must be done in accordance with the permitted workplat drawing as originally submitted on June-26, 2003. All construction must conform to the North Carolina Building COde Requirements and all other local, state and federal regulations. Any change or changes in the plans for development, construction or land use activities will require a re-evaluation, and modification of this permit. Pursuant to 15 N.C.A.C., Subchapter 7J.0406 (b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third party. This permit action may be appealed by the permittea or other qualified persons within twenty (20) days of the issuing data. From the date of an appeal, any work conducted under this per- mit mist cease until the appeal is resolved. This, permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. The attached map summarizes the plans that you and Mr. Livingston discussed. The map illustrates our plan to install a 60 ft x 15 inch plastic pipe from the highway ditch, a 60 ft long (approx.) grass drainage way and a raised bed back trilled with topsoil to further direct the water flow along the property line. Adjacent property owners James & Toni Turner and George Evins have approved these plans as indicated by their signature on the map. We are requesting a Minor Permit to allow completion of the described work. We have also illustrated areas 2, 3 and 4 on the map. We request permission to back fill these depressed areas in our yard with topsoil to allow easier grass mowing. These areas can be described as approximately 10 — 20 diameter circles (ovals) that are gradually tapered into depressed areas that are 3 -- 8 inches deeper than the surrounding yard, .14 other words, not very large but aggravating to mow. Allowing us to add topsoil to smooth out these areas is a part of the requested Minor Permit. Finally, we have enclosed a check for $100 payable to DENR for the Minor Permit. It is my understanding from discussions with Mr. Livingston that NCDOT can proceed with the installation of the 60-$, plastic pipe. However, we will wait for your issuance of the Minor Permit before proceeding with construction of the raised bed (area 1) and leveling of areas 2, 3 and 4. It is desired to conduct all of this work -within the same timeframe to minimize the mess and disruption associated with the project. Please send the permit to our home in Raleigh.
