This permit, issued on August 2 2003 Is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. '
To construct a 40' x 38' single family dwelling and a 12' x 38' deck within
575' of Jarrett Bay in the ORW (area of environmental concern).
The amount of impervious surface area shall not exceed 25% of the lot
area within the 575' area of Environmental concern (ORW).
A 30' buffer zone must be provided from the mean high water line (Not=l
Water Line).
All proposed development and associated construction must be done in
accordance with the permitted workplat drawing as originally submitted on
July 23, 2003.
All construction must conform to the North Carolina Building Code Requirements
and all other local, state and federal regulations.
Any change or changes in the plans for development, construction or land
use activities will require a re—evaluation and modification of this permit.
Pursuant to 15 N.C.A.C., SUbehapter 7J.0406 (B), this permit may not be
assigned, transferred, sold or otherwise disposed of to a third party.
This permit action may be appealed by the parmittoo or other
qualified persons within twenty (20) days of the issuing date. r
From the date of an appeal, any work conducted under this per-
mit mist cease until the appeal is resolved. V. Wmeal Local Permit Officer (signature)
. This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expiros on December
31, 2006
, In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

Dear Mr. Snipes
This is my second response to the same request regarding riparian property owner
notification for Lot #5, Backshore Lane, Smyrna. As with my prior response, I strongly
object to the placement of the proposed 40'X 38' house& attached porch so close to the
property line adjoining my house.
I have spoken at length with Miss. Britton, the owner about this. She recently indicated a
willingness to address my concerns. I repeat my request in this_ letter, that she place the
house &attached porch thirty feet (30') from my property and 30' from the property line
with lot #6.
It makes no sense to crowd my property line by placing the house at the 15' setback and
have 46' of space on the other side.
I have no objection to the distance of 60' back from the bulkhead. This will place the
house the same distance back from the water as mine.
Regarding the waiver section of the form as pertains a dock, pier, etc. I do not wish to
waive the 15' setback requirement.
In summary, I will not sign the my approval of the adjacent riparian property owner
notification/waiver form with the present placement of the house. I request the house be
placed 30' from each adjoining property line.
