BEAUFORT as requested in the permittee's application, dated 02-17-03 This permit, issued on 02-28-03 . is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes the renovation and expansion of the structure known as The Beaufort House, contingent upon the following conditions: All proposed development and associated construction must be done in accordance with the application dated 02-17-03; workplat drawing (s) dated 01-07-03, and originally submitted on 02-17-03. 2. All construction must conform to the North Carolina Building Code requirements and all other Local, State and Federal regulations. 3. Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. 4. Through this proposal, impervious area will be reduced from 93% to 90%, and is therefore consistent with 15 A NCAC.07J.0211 * See Page 2 for additional conditions. * This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m.st cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31. In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This development is located at the end of Gibbs Creek Rd., adjacent to Turner Creek, in Carteret County. The development was undertaken within the Public Trust and Estuarine Waters, designated Areas of Environmental Concern, and no permit has been issued for it. Therefore, I have concluded that you are in violation of the permit requirement of the Coastal Area a Management Act. I request that you immediately CEASE AND DESIST any further development and contact me about this matter. If the development you have undertaken is not consistent with the applicable standards, you will be required to restore the area to its former condition. A civil assessment of up to $2500.00 may be assessed against any violator. Each day that the development described in this Notice is continued or repeated may constitute a separate violation that is subject to an additional assessment of $2500.00. An injunction or criminal penalty may also be sought to enforce any violation, NCGS 113A-126. It is the policy of the Coastal Resources Commission to assess a minimum civil penalty of Two Hundred Dollars ($200.00) against all violations of this type. This is done to recoup some of the costs of investigating the violation and/or to compensate the public for any damage to its natural resources. Whether a higher amount will be assessed will depend on several factors, including the nature and area of the resources that were affected and the extent of the damage to them.
