It has been designed to be straightforward and require no more time or effort necessary from theapplicant. Under CAMA regulations, the minor permit is to be issued within 25 days once a complete application is in ,. _.; hand. Often less time is needed if the project is simple. The process generally takes about 18 days. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes an eight foot wide grass paver system terminating short of the sixty foot structure setback and an eight foot wide "Hatteras Ramp" terminating short of the first line of stable natural vegetation. All development is being proposed at an existing public beach access just west of the Coral Bay Club parking lot in Atlantic Beach. Any other development will require additional permits or a modification of this permit. The following conditions shall apply: All proposed development and associated construction must be done in accordance with the application dated November 4, 2002, workplat drawing(s) stamped received on November 3, 2002. 2. All construction must conform to the North Carolina Building Code requirements and all other Local, State and Federal regulations. 3. Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. * See page 2 for additional conditions. * This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m.st cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31 2005 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party by the applicant, agent, or any entity other than the NC Division of Coastal Management. 5. A copy of this permit shall be available onsite for regulatory inspection. 6. Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is not weakened or reduced. Disturbed areas will be immediately stabilized vegetatively. No development shall involve the significant relocation, removal of primary or frontal dune sand, or vegetation thereon. 7. This permit may be renewed for one (1) year if requested before the expiration date. S. The permittee is required to contact the DCM Field Representative shortly before he plans to begin construction to arrange a setback measurement, which will be effective for sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be re-established. 9. Adding to the dunes shall be accomplished in such a manner that the damage to existing vegetation is minimized. The filled areas will be immediately stabilized vegetatively. 10. Sand held in storage in any dune, other than frontal or primary dunes, may be moved laterally in order to strengthen existing primary or frontal dunes if the work would enhance the protection to the proposed development activity and the sand is immediately stabilized vegetatively. This work must be accomplished landward of the toe of the frontal dune and the crest if the primary dune. 11. Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach re - nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. 12. The activity must not exceed the lateral bounds of the applicant's property unless he has permission of adjoining landowners. 13. The area on which this activity is being performed must maintain a slope of adequate grade so as not to endanger the public or the public's use of the beach, and should follow the natural slope as closely as possible. NC 28557 February 14, 2002 The Coastal Management Office North Carolina Department of Environment and Natural Resources 151-B Highway 24 Morehead City, NC ATTN: Ms. Kathy Vinson RE: Public beach access at the end of Commerce Way and west of the Coral Bay Club - Atlantic Beach, NC Dear Ms. Vinson: I hereby certify that I am a member in good standing of the bar of the State of North Carolina and that I have been requested to determine record ownership of the following two parcels of property over which the Town of Atlantic Beach plans to construct public beach access. I. -The eastern 25 feet of the southern terminus of Commerce Way. Summary Opinion. The best argument is that Commerce Way was dedicated, at least by implication, all the way to the public trust beach of the Atlantic Ocean and that the Town's acceptance of this dedication establishes the legal right in the Town to use the street end for public beach access. An analysis of this opinion follows. Commerce Way is shown on the plat of Asbury Beach subdivision recorded in Map Book 2, Page 48, Carteret County Registry. A copy of this plat is attached and the area in question is highlighted. Commerce way has been accepted as a municipal street by the Atlantic Beach Board of Commissioners. To the extent Commerce Way appears on the Asbury Beach Subdivision map, it is a municipal street and subject to use by the Town for public beach access. There is a question as to whether Commerce Way, as platted, extends all the way to the public trust beach or high water mark of the Atlantic Ocean. While subject to different interpretations including previous interpretations from this office, in my opinion Nov 06 02 O9:49a RB Public Works 252 726 4460 2 - the best argument is that Commerce Way was dedicated at least by implication, all the way to the public trust beach and that the Town's acceptance of this dedication establishes the legal right in the Town to use the street end for public beach access. There are publicly recorded documents supporting this opinion. The ocean front condominium project to the east of Commerce Way, "A Place at the Beach - Atlantic Beach II" (now known as "Sea Spray") was established by Declaration of Unit Ownership dated February 26, 1981 recorded in Book UO9, Page 83, carteret County Registry. The declaration describes the western boundary of the project as running "in a southerly direction along the eastern margin of Commerce Way S 03-00 W 686.36 feet to a point in the high water mark of the Atlantic Ocean." On the west side of Commerce Way at the ocean front is a condominium project known as Eagles Nest. This project encroaches 25 feet into the 50 foot Commerce Way right-of-way (Note: To avoid a conflict with Eagles Nest we simply recommend that the Town place its access. in the unclaimed eastern 25 feet of Commerce Way.) There is a redivision map of Asbury Beach recorded in Map Book 3, Page 30, Carteret County Registry which depicts Commerce Way as extending to the high water mark.. We enclose this map (even though it is of very poor quality). While this map is useful, and supports our opinion, the owners of the lots shown did not actually have a deed for property that includes Commerce Way and thus the map itself does not completely settle the issue. Finally, the tax records indicate no claim of private ownership to the subject portion of Commerce Way. In summary, in my opinion the best argument is that Commerce Way in the original plat of Asbury Beach either expressly or by implication was extended to the public trust beach of the ocean and as a result is under the jurisdiction of the Town of Atlantic Beach as a municipal street. There is sufficient municipal interest in this street end to justify the expenditure of public monies to improve the beach access and that the risks of legal challenge are minimal and acceptable. 2. Alley on the western side of the Coral Bay Club. Summary opinion: The Town has sufficient interest in the alley to declare it a point of public beach access and to expend public monies in the maintenance of the same. An analysis of this opinion follows. The Town acquired colorable title to the alley in a quit claim deed from Bogue Shores Homeowners Association, Inc. dated February 5, 2002, recorded in Book 931, Page 675, Carteret County Registry. While the alley was not dedicated on a plat or in a deed, our research of title reveals references to the alley approximately p.3 Nov 06 02 O9:49a AB Public Works 252 726 4460 p.4 - 3 - thirty five years ago by family members that owned that part of Atlantic Beach in the 1940's and 501s. From my personal knowledge the alley has been used continuously, openly, and under a claim of right over the last 20 years by various owners at Bogue Shores Condominiums (on the north side of Salter Path Road) to access the beach. Also from my personal knowledge I can state that the alley features a wooden boardwalk that has been in place for over 20 years and that it is bounded on the east by the Coral Bay Club parking lot fence which has been in place for at least 20 years. The area is shown on the Carteret County tax records as an alley and not under private ownership. We have access to the tax maps back to the early 1970's and this has been consistently depicted. The property on which the alley is located was owned by the Smith and Taylor families in the 1940's and 501s. While the Smith and Taylor families never platted an alley on any recorded plat we have been able to find, in a deed dated May 3, 1967, recorded in Book 289, Page 365, Carteret County Registry, the heirs of the Smith and Taylor families deeded nearby property and used the alley as the beginning point. In relevant part the deed description references the northwest corner of the Coral Bay Club property as "being the northeast corner of a 12 foot walkway running from Salter Path Road to the Atlantic Ocean along the west line of the Coral Bay Club property." A deed dated 1, 1967 recorded in Book 289, Page 369 Carteret County contains the exact language. The grantor of the recent quitclaim deed to the Town is the owners association for Bogue Shores condominiums which is on the north side of Salter Path Road across from the alley. Bogue Shores Condominium was established by a Declaration of Unit Ownership dated October 5, 1981 recorded in Book Uo-10, Page 212, Carteret County Registry. The condominium plats attached to the Declaration depict the alley in question. From my personal knowledge I am aware that Bogue Shores Condominium owners have continuously and openly used the alley since the establishment of the condominiums under a claim of right based on the plat attached to the declaration. As a result, the quit claim deed to the Town puts the Town in a good position to be able to defend a public beach access over the alley. What is now Bogue Shores Condominiums was constructed we believe in the 1970's as the Landmark Inn. We have anecdotal evidence that the motel guests at the Landmark Inn used the alley to access the ocean during the time the motel was open. Additionally, on the west side of the alley is a two unit condominium project known as Coral Dunes Condominiums. A plat of Coral Dunes is recorded in Map Book 10G at Page 14, Carteret County Registry and a copy is attached. This plat clearly shows the alley in question. If any private party tried to close the alley, we are confident that the Town, perhaps with the joinder of the individual owners of Bogue Shores Condominiums, would be successful in keeping the alley open for public use.
