Issued to the Town of Atlantic Beach, authorizing development in the Ocean Hazard (AEC) at Durham Avenue
Public Beach Accessway in Atlantic Beach, as requested in the permittee's application, dated 9/17/01. This
permit, originally issued on 2/27/02, renewed on January 31, 2006, is subject to compliance with the
application and site drawing (where consistent with the permit), all applicable regulations and special
conditions and notes set forth below. Any violation of these terms may subject permittee to a fine,
imprisonment or civil action, or may cause the permit to be null and void.
This minor permit authorizes the extension of the Durham Avenue public beach accessway seaward of
the first line of stable natural vegetation. This extension request has been made possible by a Final
Order granting Variance (CRC VR 01-33) from T 15A NCAC 7H.0305(e) and .0309(a). The following
conditions apply:
1. All proposed development and associated construction must be done in accordance with the permitted
workplat drawing(s) as originally submitted on November 7, 2001.
2. All construction must conform to the North Carolina Building Code requirements and all other Local,
State and Federal regulations.
3. Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.
4. Accessways shall be exclusively for pedestrian use, shall be no more than six feet (6) in width, and
shall be elevated on pilings of no more than five feet (5) in depth so that only the pilings touch the
sand.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this permit expires on
December 31, 2006
In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management. .

Please find enclosed a request from the Town of Atlantic Beach to renew CAMA Minor Permit
#04-02. This permit was issued 2-27-2002 and expired on December 31, 2005. Because of
budget constraints, grant funding, and the hurricane Ophelia, the project was delayed. In
accordance with 7J.0404(b), I recommend that this permit be renewed for another year.

In February 2002 the Town was issued a CAMA Minor Development Permit to construct
a handicap accessible beach access boardwalk at our Durham Ave. location. This permit
is set to expire on December 31, 2005. The intent of this letter is to request an extension
of this permit due to unforeseen delays.
As previously discussed with you, the Town received a CAMA grant in November 2004.
However, informal bids were substantially higher than expected. Further funding was
made available in the normal budgeting process for the Town in July 2005. As with all
beach access projects, we attempt to construct these amenities during the off season so as
to not interrupt free access to our beaches during the summer season. In September,
hurricane Ophelia did considerable damage to our town.
It is requested that a six-month extension of this permit be granted. I have enclosed a
copy of the existing permit for your convenience. Any assistance you could give us in
this matter would be greatly appreciated. I thank you in advance for your consideration.

This matter was heard on oral arguments and stipulated facts at the regularly scheduled
meeting of the North Carolina Coastal Resources Commission (hereinafter CRC) on January 23,
2002, in Elizabeth City, North Carolina pursuant to N.C.G.S. § 113A-120.1 and T15A NCAC
7J.0700, et sea. Assistant Attorney General David G. Heeter appeared for the Department of
Environment and Natural Resources, Division of Coastal Management; Petitioner Town Of Atlantic
Beach did not appear.
Upon consideration of the record documents and the arguments of the parties, the CRC
adopts the following:
STIPULATED FACTS
1. The Town of Atlantic Beach is an incorporated body politic in Carteret County, North
Carolina.
2. In the early 1980s, the Corps of Engineers expanded the beach at Atlantic Beach using
spoil material from the maintenance dredging of the Morehead City harbor.
3. The Corps of Engineers' spoil deposition project was a large scale project under
Rule 15A NCAC 7H .0305(e).
4. Before the beach was expanded, a bulkhead running along the oceanfront coincided
with the first line of stable natural vegetation and was used to locate that line.

5. Under Rule 15A NCAC 7H .0305(e), the buried bulkhead has continued to serve as
the first line of stable natural vegetation.
6. The Town installed an accessway at the end of Durham Street to give the public
access to the expanded beach.
7. Over the years, the width of the beach has expanded significantly due to the
deposition of spoil, and a dune system has formed several hundred feet waterward of the Durham
Street accessway.
8. Persons who gain access to the beach via the Durham Street accessway walk over the
dune system to get to the ocean.
9. The dune system proximate to the Durham Street accessway is being damaged by
people walking over it, and this may destabilize the dune system and weaken its protective value.
10. The Town of Atlantic Beach sought to protect the dune system from further damage
by applying for a CAMA minor development permit to extend the Durham Street accessway
seaward over the dune system.
11. The Division of Coastal Management denied the Town's CAMA permit application
because the buried bulkhead serves as the vegetation line under Rule 15A NCAC 7H .0305(e) and
the access way is not allowed seaward of the vegetation line under Rule 15A NCAC 7H .0309(a).

Based on the foregoing Stipulated Facts, the Coastal Resources Commission
CONCLUSIONS OF LAW
1. The CRC has jurisdiction over the parties and the subject matter.
2. The parties have been correctly designated and there is no question of misjoinder or

nonjoinder of parties.
3. All notices for the proceeding were adequate and proper.
4. Application of 15A NCAC 7H.0305(e) and .0309(a) to the beach accessway will
result in practical difficulties or unnecessary hardships in that foot traffic will damage the vegetation
along the buried accessway.
5. At the time that it adopted 15A NCAC 7H.0305(e) and .0309(a), the Coastal
Resources Commission could not reasonably have anticipated that the rules would prohibit a
measure for dune protection such as the one proposed.
6. The proposed development is within the spirit, purpose and intent of the
Commission's rules in that the rules allow the extension of beach accessways seaward to the
vegetation line.
THEREFORE, the petition for variance from T15A NCAC 7H.0305(e) and .0309(a) is
GRANTED to allow construction of the proposed beach accessway.

RULE ISA► NCAC 7H .0305(e) "Vegetation Line"
(e) "Vegetation line means the first line of stable natural vegetation, which shall be used
as the reference point for measuring oceanfront setbacks.... In areas within the boundaries of a large
scale beach nourishment or spoil deposition project, the vegetation line that existed before
commencement of the project shall be used as the vegetation line for determining oceanfront
setbacks after the project is completed. A project shall be considered large scale when:
(1) it places more than -a total volume of 200,000 cubic yards of sand at an average ratio
of more than 50 cubic years of sand per linear foot of shoreline... .

because of a spoil deposition project and that a dune system which requires protection has
formed on this part of the expanded beach.
(c) Could the Coastal Resources Commission have reasonably anticipated these
conditions when the applicable guidelines or standards were adopted?
Petitioner: No. While the existing regulation forbidding communities that participate in
a organized beach re -nourishment project from taking advantage a reestablished first line of
stable vegetation is the reason why we are seeking this variance request, the CRC could not have
foreseen this problem when adopting the regulation. The Town of Atlantic Beach recognizes that
the existing regulation is necessary to ensure that local property owners do not exploit the
positive results generated by an organized beach re -nourishment project and further destabilize a
dune system. We believe, however, that our request is an effort to guarantee the protection of
this dune system and that the positive benefits generated by the re -nourishment of our local
beaches is not undone.
Staf. No. In all likelihood, the Commission did not anticipate that a spoil deposition
project would result in such a significant expansion of the beach that a community would want to
extend a public access way so far beyond the preproject vegetation line.
(d) Is the proposed development consistent with the spirit, purpose, and intent of the
Commission's regulations?
Petitioner: Yes. The Town of Atlantic Beach asserts that the Commission has always
supported, and even encouraged, the development of walkways as a practical way to protect
existing dune systems while still allowing public access to local beaches. All the Town of
Atlantic Beach is asking for is a variance to extend an existing walkway and protect an existing
dune system from potential damage, and destruction, as a direct result of the areas popularity as a
public beach access site.
Stab Yes. The extended walkway will help protect the dune system from damage while
providing public access to the expanded beach all of which is consistent with the Commission's
oceanfront policies and regulations. If the Corps of Engineers discontinues depositing spoil on
the beach, the access way can be easily removed by the Town.

Dear Mr. Walker,
This letter is in response to your CAMA Minor Permit Application received complete to this office on
November 7, 2001. After reviewing your application in conjunction with the development standards
required by the Coastal Area Management Act (CAMA) it is my determination that no permit may be
granted for the project you have proposed.
This decision is based on NCGS 113A-120 (8), which requires that all applications that are inconsistent
with CAMA guidelines be denied. You have applied to extend the existing public beach access site, at the
corner of West Boardwalk Ave. and Durham Ave. in Atlantic Beach, Carteret County, seaward of the first
line of stable natural vegetation. It is important to note that the first line of stable natural vegetation "in
areas within the boundaries of a large scale beach nourishment project or spoil deposition project, the
vegetation line that existed before commencement of the project shall be used as the vegetation line for
oceanfront setbacks after the project is completed." (15A NCAC 07H.0305 (e)) Atlantic Beach was part
of a large-scale deposition project in the middle `80s and the first line of stable natural vegetation at the
aforementioned application site is the buried bulkhead. which existed prior to the deposition project. The
proposed development is inconsistent with 15A NCAC 07H.0309 (a) which states beach accessways
"shall only be permitted if it is landward of the vegetation line.."
Should you wish to appeal my decision to the Coastal Resources Commission or request a Variance from
that group, please contact me so that the appropriate forms may be completed for the Commission's
review. The Division of Coastal Management in Raleigh must receive appeal notices within twenty (20)
days of your receipt of this letter in order to be considered.

I have received the attached variance request from the Town of Atlantic Beach. The Town
is seeking a CAMA permit to extend the existing public access walkover to a point seaward of
the first line of stable natural vegetation. Prior to the renourishment of the beach, an old bulkhead
was designated as the preproject vegetation line, and the rules of the Coastal Resources
Commission preclude extending the walkover seaward of this bulkhead. The actual first line of

I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.
PERMISSION TO ENTER ON LAND
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer
and his agents to enter on the aforementioned lands in connection with evaluating information related to this
permit application.
This application includes: general information (this form), a site drawing as described on the back of this application,
the ownership statement, the AEC hazard notice where necessary, a check for $100.00 made payable to the locality,
