This permit, issued on 01-1 5-09 . is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes grading and filling for landscape purposes, and septic tank installation,
contingent upon the following conditions:
1. Before installation of the septic system, an Authorization for Wastewater System Construction
Permit must be obtained from the Carteret County Health Department.
2. No excavation, filling, or other disturbance of wetlands is authorized under this permit.
3. The bulkhead and residence shown on the submitted plat are not addressed or authorized under
this permit.
4. The coastal marsh line must be delineated by the DCM within 90 days of ground disturbing
activity taking place.
5. The grading of this lot must not increase stormwater runoff to the waters of Straits.
* See page 2 for additional conditions. *
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit m.st cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December
31,2005
In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

6. The area within 30' of the Normal High Water Contour Line must remain in a vegetative state.
7. All proposed development and associated construction must be done in accordance with the
permitted workplat drawing(s) as originally submitted on 12-31-01.
8. All construction must conform to the North Carolina Building Code requirements and all other Local,
State and Federal regulations.
9. Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.
10. Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales, or burlap
must be installed between the land -disturbing activity and the adjacent marsh or water areas, until such
time as the area has been properly stabilized with a vegetated cover.
11. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or
otherwise disposed or to a third -party.

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you wjll find a "Notice of Permit Filing" postcard which must be posted at
the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:

SUBJECT: On -Site Wastewater System Setbacks from "Marshes"
Thank you for the inquiry and recent communications regarding the application of the Commission for
Health Services rules governing the minimum separation distance between "marshes" and on -site
wastewater systems. More specifically, the issue relates to the location of on -site wastewater systems in
juxtaposition with surface waters and jurisdictional wetlands, found in tidal zones of the lower coastal
plain of North Carolina,
It may be of interest to note that this was an issue in the mid 1980's that was supposedly resolved when
the Commission for Health Services (CHS) more clearly defined "mean high water mark" to closely
agree with the definition applied by the Army Corps of Engineers and the Coastal Management
Commission [Ref. 15A NCAC 18A .1935(15)]. The CHS rules require the permit applicant to give
notice to the local health department of designated wetlands and prohibits the installation of an on -site
wastewater system in designated wetlands unless the appropriate wetland permit is issued and the local
health department determines that an Improvement Permit (site approved) can be issued.
Where marshes are involved during a site evaluation for an Improvement Permit it must be determined
whether it is a wetland or considered as one of the varieties of surface waters. The mean high water
mark is typically established by a Registered Land Surveyor based on long-term (19 year) high water
elevation data. The wetlands delineation is determined by less exacting methods by a variety of
individuals. The term "Coastal Wetlands/Marshes" has been possibly used to include marshes that are
more correctly wetlands. Nevertheless, the CHS rules treat marshes that are routinely flooded within the
definition of mean high water as a surface water and appropriate setbacks are applied.
In situations where wetlands are determined to exist, no system setback is specifically required but the
soil/site conditions typically mandate some separation except when another agency allows a bulkhead to
be installed. Also, conditional site modifications such as fill systems may be approved up to the
designated wetland.

sources are incorporated without reference in any permit which may be issued. Deviation from these details will

SITE DRAWING/APPLICATION CHECKLIST
Please make sure your site drawing includes the following information required for a CAMA minor develop-
ment permit. The drawing may be simple and not necessarily to scale. The Local Permit Officer will help you,
if requested.
PHYSICAL DIMENSIONS
label roads
label highways right of ways
label local setback lines
label any and all structures and driveways currently existing on property
PHYSICAL CHARACTERISTICS
draw and label mean high water mark
draw location of on -site wastewater system
If you will be working in the ocean hazard area:
draw and label dune ridges (note height)
draw and label toe of dune
identify and locate first line of stable vegetation
draw and label setback line under CAMA
draw and label topographical features (optional)
If you will be working in an estuarine shoreline area:
draw and label landward limit of AEC
describe terrain (slope)
DEVELOPMENT PLANS
draw and label areas that will be disturbed
if a house is to be placed on lot, describe location of house
note size of piling and depth to be placed in ground
draw and label all areas to be paved or graveled
