with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
Beach Bulldozing TI5A:07H .1805 Specific Conditions:
(a) The area in which this activity is being performed must maintain a slope of adequate grade so as to not endanger
the public or the public's use of the beach and should follow the pre -emergency slopes as closely as possible. The movement of
material by a bull -dozer, front-end loader, backhoe, scraper or any type of earth moving or construction equipment shall not
exceed 1 foot in depth measured from the pre -activity surface elevation.
(b) The activity must not exceed the lateral bounds of the applicant's property unless he has the written permission of
the adjoining landowner(s).
(c) Movement of material from seaward of the mean high water line is not authorized
(d) The activity must not significantly increase erosion on neighboring properties and must not have a significant
adverse effect on important natural or cultural resources.
(e) Adding to dunes shall be accomplished in such a manner that the damage to existing vegetation is minimized The
fill areas will be immediately replanted or temporarily stabilized until planting can be successfully completed
(f) In order to minimize adverse impacts to nesting sea turtles, no work shall occur within the period of May 1 through
November 15 of any year.
(g) If one contiguous acre or more of oceanfront property is to be excavated or filled, an erosion and sedimentation
control plan must be filed with the Division of Land Resources, Land Quality Section, or appropriate local government having
jurisdiction. This plan must be approved prior to commencing the land disturbing activity.

EACHAND EVERY TEVIE THE PROPERTY IS BULLDOZED ONLY DURING THE PERIOD OF
NOVEMBER IS THROUGHAPRIL 30 FOR THE DURATION OF THIS PERMIT
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit must cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December

In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.

CAMA Permit Notice
Pursuant to NCGS 113A-119(b), Emerald Isle, a locality authorized to issue
permits in Areas of Environmental Concern, hereby gives NOTICE that on
February 12, 1999, David Schmidt, applied for a Minor Permit to beach bulldoze
at 7519 Ocean Drive, Lots, 9, 10, 11, Block 33, , from high water mark landward.
The application may be inspected at the address below. Public comments
received by March 2, 1999 will be considered. Later comments will be accepted
and considered up to the time of permit decision. Project modifications may occur
based on further review and comments. Notice of the permit decision in this
matter will be issued upon written request.

I am writing as your next door neighbouto the west at Emerald Isle to solicit your approval to
allow sand to be pushed up to recreate the dune in front of our property. You had this done to
your beach front following the hurricanes we suffered in 1996. According to the Town of
Emerald I need your approval in order to obtain a permit to allow me to do this. I feel it is
necessary in order to protect not only my property but those on either side of mine.
Would you kindly sign below signifying your approval to allow sand to be pushed up from the
beach in front of my property to recreate the dune in front of our property at 7519 Ocean Dr. and
return this letter in the enclosed envelope.
