This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under the Coastal Resources Commission Rules. 3) In order to avoid unreasonable danger to life and property, all development shall be designed and placed so as to minim; damage dueto fluctuations in ground devatio and wave action in a 100 year storm Cantilevered decks and walkways shall meet this standard or shall be designed to break -away without structural damage to the main structure. Any building constructed within the ocean hazard area shalt comply with the North Carolina Building Cade ntcuding the Coastal and Flood Plant Construction Standards, Chapter 34, Volume I or Section 39, Volume 1-B and the local flood damage prevention ordinance as required by the National Flood Insurance Program. Nany provisions ofthe building code or a flood damage prevention ordinance is inoauistent with any ofthe AEC standards, the more restrictive provision shall control. 4) The structure must be set baek4, 0 feet from the first Ime of stable, natural vegetation. - 5) The structure must be located artirely offthe &natal dune, and, if a primary dune is present, behind the crest ofthe primary dune. 6) The structure must be elevated on pilings with a diameter of at least eight (8) inches and the first floor level ofthe sills and joists must meet the minimal 100 year flood as required by FIRM Community Panel 370047-M I D. 7) All pilings shall have a tip penetration of at least five (5) feet below mean sea level, or sixteen (16) feet below average original grade, whichever is least; if located on a primary dune, the tip Penetration must be at least five (5) feet below mean sea level. 8) No impermeable surfaces shall be allowed over any fimctional part ofthe septic tank system. 9) Dune disturbances will be allowed only to the extent necessary for development, and if the dune's protective value is not weakened or reduced.
