Notice is hereby given that The Town of Atlantic Beach has applied to the Department
of Environment, Health and Natural Resources for a Minor Development permit. The applicant
is requesting to construct a retaining wall, install a subsurface irrigation system and to backfill,
grade and landscape the property.
Persons desiring to inspect the application, or to comment thereon, are directed to contact
M. Ted Tyndall, Field Representative, Division of Coastal Management, in the Marine Fisheries
Building, Morehead City, NC, Telephone (919) 726-7021, no later than March 2, 1995.
Comments received prior to that date will be considered in making the permit decision. Later
comments will be accepted and considered up to the time of permit decision. Project
modifications may occur based on further review and comments. Notice of the permit decision
in this matter will be provided upon written request.

Dear Mr. Holycross:
The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for minor development of your property located at 115 Atlantic Boulevard,
in Atlantic Beach, Carteret County. It was received on 21 December 1994 and on 13 January
1995 the Division requested additional information and extended the time period within which
a decision shall be made by an additional twenty-five days. This information was submitted on
9 February 1995 thus the application appears to be adequate for processing at this time. The
projected deadline for making a decision is. 6 March 1995.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be

This application for a minor development permit under
CAMA is part of the Commission's effort to meet the
spirit and intent of the General Assembly. It has been
designed to be straightforward and require no more
time or effort necessary from the applicant. Please go "

Under CAMA regulations, the minor permit is to be

Pursuant to your request for additional information pertaining to the Town's application
for a minor CAMA permit for the property located at 115 Atlantic Blvd., I am enclosing a scaled
map for your review. Please be advised that since the enclosed map was drawn, the structure on
the property known as the "Pavilion" has been demolished and removed. In addition, the
following information should complete your request:
1) The amount of fill proposed to be added to the property is approximately 2500 cubic yards of
sand for the purpose of raising the site elevation approximately two and a half feet to the base
flood elevation of eleven feet above sea level.
2) The proposed retaining wall will encircle the property and be constructed of split face concrete
block. The height of the wall will be approximately two and a half feet and the width will be
about 10 inches (the width of a single concrete block)..

we have discovered that it lacks certain necessary information. Accordingly, we request that
you provide the following information:
1) label all adjacent property owners' property,
2) label all existing structures, parking lots, septic systems, etc.,
3) provide an accurate scale on the plat entitled "Town Commons Building Area
Study",
4) estimate the amount of fill (yds3) to be added ... also what is the base flood
elevation at the project site, and
5) indicate more clearly the type, size and location of the proposed retaining
wall.
In accordance with the Department of Environment, Health and Natural Resources
regulations, we note that a certain time has passed while the application has remained in our
office. Accordingly, upon resubmission of the requested information, and pursuant to NCGS
113A-121(b), in order to properly consider all information necessary to making a decision on
this permit application, the time period within which a final decision shall be made has been
extended an additional twenty-five (25) days from the date that the additional information is
received in our office.

As you may know, the Town of Atlantic Beach is making an extensive effort to revitalize
the "Circle" area of our community. As part of that effort, the Town Board has approved
a plan for Phase I improvements at the Circle that will include the reconstruction of
Atlantic Boulevard, the reconstruction of the pedestrian walkways leading to the
boardwalk, significant improvements to the boardwalk, the installation of underground
utilities, and the demolition of the old, boarded -up Pavilion building. The improvements
will also include new pedestrian walks, landscaping, decorative street lighting, signage,
and street furniture. Contracts for the street and utility construction should be awarded in
January and the construction should be substantially completed by Memorial Day.
So that we may proceed with the Phase I improvements, the Town has made application
to the Division of Coastal Management for a minor CAMA permit to modify the Pavilion
building and property. The permit application requests authorization to demolish the
Pavilion building, to place fill dirt as necessary to raise the property to base flood
elevation, to install a retaining wall along the pedestrian walkways (alleys), to install a
subsurface irrigation system, and to grade and landscape the site.

I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.

and his agents to enter on the aforementioned lands in connection with evaluating information related to this
permit application.
This application includes: general information (this form), a site drawing as described on the back of this ap-
plication, the ownership statement, the AEC hazard notice where necessary, a check for $50.00 made payable to

Please make sure your site drawing includes the following information required for a CAMA minor develop-
ment permit. The drawing may be simple and not necessarily to scale. The Local Permit Officer will help you,
if requested.
