SUBJECT: Walkway at 208 Club Colony

Dear Mr. Pollock:
I received your May 25, 1995 letter and due to the urgency of this situation, I
will attempt to.respond immediately to your concerns.
Normally more than 10 days is allowed to correct a CAMA violation. However, as
I pointed out in my May 19, 1995 letter, the recently constructed walkway blocks
access for emergency vehicles along the beach during high tide. Therefore, it
is urgent that the access be cleared immediately.
Your additional concerns are addressed as follows:
1. The first line of stable vegetation is defined as a line established by
the Corp. of Engineers prior to the spoil dumpage. The established line
is at a bulkhead, buried or otherwise, or the old highwater mark. In this
case, the aforementioned line is approximately 30 feet north of the
waterward end of the subject walkway.
2. I have no doubt that the survey referred to in your letter goes onto the
beach. I am attaching a copy of NC General Statute 146-6. Please note
that all land abutting the Atlantic Ocean raised by public funds shall
remain open to the free use and enjoyment of the people of the State. The
area in question was raised by public funds in 1986 and the walkway denies
the public of its free use.
3. We encourage protection of established vegetation along the beach.
However, if so doing denies the public free use of the beach, it may be in
violation of the aforementioned General Statute.

Since my letter requests the walkway to be removed within 10 days of, receipt of
the letter, I do not feel an extension is justified. Please remove.the walkway
immediately.
