We have reviewed the information submitted to this office in your inquiry
concerning the necessity of filing an application for a minor development permit
under the Coastal Area Management Act. The activity you propose is exempt from
needing a minor development permit as long as it meets the conditions specified
below. If your plans should change and your project will no longer meet those
conditions, please contact me before proceeding.
DESCRIPTION OF ACTIVITY AND CONDITIONS: According to your contractor, you
propose to replace your existing dock, and install piles and dead men along
bulkhead located at 107 Brooks Avenue, Atlantic Beach, NC.
Private, non-commercial piers/boatlifts/mooring facilities may be constructed if
it does not exceed 200' in total length offshore; is not within 150' of a
federally maintained channel, does not extend beyond the 4' mean low water
contour line or normal water level, (whichever is applicable) of the waterbody;
does not exceed 6' in width; does not include an enclosed structure; and, does
not interfere with established navigation rights. The 4' mean low water
restriction shall not apply to piers/boatlifts/mooring facilities constructed on
man-made canals and basins. It may be built through wetland vegetation only if
elevated and may have a T-head or platform not exceeding 500 square feet in area
at its waterward end if no wetland areas are covered. The pier/boatlift/mooring
facilities must be set back a minimum of 15' from the adjacent property owner's
area of riparian access unless waived by a written agreement. Confirmation must
also be given that written statements have been obtained from adjacent riparian
property owners indicating that they have no objections to the proposed
construction. The pier/boatlift/mooring facilities shall not extend beyond the
established pier length along the same shoreline for similar use, and in no case,
extend more than one-third (1/3) of the width of the waterbody and shall not
interfere with shellfish franchises or leases. Also, piers /boatlifts/mooring
facilities authorized by this exemption shall be for the exclusive use of the
landowners, and shall not provide either leased or rented docking space or any
other commercial services. Piers/boatlifts/mooring facilities designed to
provide docking space for more than four (4) boats shall, because of their

greater potential for adverse impacts, be reviewed through the permitting
process, and are, therefore, not authorized by this exemption.
This certification of exemption from requiring a CAMA permit is valid for ninety
(90) days from the date of issuance. Following expiration, a reexamination of
the project and project site may be necessary to renew this certification.

RE: Seawall and dock on canal
Please be advised that we are planning to repair the seawall behind
the cottage (which is eroding) and replace the dock with one of the
same size, since the old one is falling in the canal!
By ordinance, we must inform adjoining property owners and verify
that they concur with.our course of action.
