Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1. Work authorized includes the minor grading and redistribution of sand in an area 25 x 300 waterward of the seawall and above the mean high water mark. 2. No excavation below one foot in depth is allowed, except in immediate area of seawall. 3. No work is allowed outside the lateral bounds of the applicant's property without written approval of the adjacent owners; 4. Erosion on adjacent properties shall not be increased as a result of this activity; 5. The slope shall stay effectively the same before and after this activity; 6. Material will be redistributed on land owned by applicant which are located oceanward of existing bulkhead, and are above the mean high water line; 7. The contours of the beach will be retained in their typical configurations. 8. No vegetation disturbance is allowed; 9. In order to minimize adverse impacts to nesting sea turtles, no work shall occur within the period May 1 through November 15, of any year without prior consultation by the Division of Coastal Management; 10. Prior to beginning of work, the applicant must contact the local permitting officer 11. Any further development must have consultation authorization. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date// From the date of an appeal, any work conducted under this permk must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance.
