This permit, issued on August 15, 1994Js subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1. Any structure shall be relocated or dismantled when it becomes imminently threatened by change
in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years
of the time when it becomes imminently threatened, and in any case, upon its collapse or
subsidence. However, if natural shoreline recovery or beach nourishment takes place within two
(2) years of the time the structure becomes imminently threatened, so that the structure is no
longer imminently threatened, then it need not be relocated or dismantled at the time. This
condition shall not affect the permit holders right to seek authorization of temporary protective
measure allowed under 7H.0308(a)(2).
2. Any building constructed within the Ocean Hazard Area shall comply with the North Carolina
Building Code, including the Coastal and Flood Plain Construction Standards, Chapter 27,
Volume II, and the Pine Knoll Shores Flood Damage Prevention Ordinance as required by the
National Flood Insurance Program. If any provision of the Building Code or Flood Damage
Prevention Ordinance is inconsistent with any of the AEC Standards, the more restrictive
provision shall control.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this permit
must cease until the appeal is resolved.
This permit must be on the project site and accessibletothe
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on
December 31. 1994
In issuing this permit it is agreed that this project is consis-
tent with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

ATTACHMENT 'A'
APPLICANT: Albert L. Wiley, Jr.
LOCATION: Lot #1, Tanglewood Ridge Subdivision
3. The permitted development and associated construction shall be undertaken in accordance
with the approved workplat drawing dated 07-18-94.
4. All construction activities shall conform to all Indian Beach/Carteret County ordinances
and regulations.
5. All development authorized by this permit (i.e., the house) must be designed and situated
on the property so as to minimize damage due to fluctuations in grown elevation and
wave action in a 100-year storm.
✓6. The permitted house must be set back at least 60' from the first line of natural stable
vegetation as identified by the CAMA Permit Officer.
7. The permittee and/or the contractor is required to contact the Local Permit Officer
shortly before beginning construction to arrange a setback measurement which will be
effective for sixty (60) days barring a major shoreline change. Construction must begin
within this sixty (60) day period or the measurement is void and must be re-established.
8. The house to be constructed in the Ocean Hazard Area shall be constructed on a pile
foundation. Round timber piles shall not be less than 8" in diameter, or square timber
piles shall not be less than 8" square, nominal. All pilings within the Ocean Hazard
Area shall have a tip penetration of at least 5.0' below mean sea level or 16' below
average original grade, whichever is least. The sills and joists of the lowest floor must
meet the 100-year flood level elevation of 16'.
9. The structural accessway must not exceed 6' in width.
10. The structural accessway must be raised on posts or pilings of 5' or less in depth so that
only the vertical supports come in contact with the frontal dune.
11. Any areas of vegetation that are disturbed in the course of constructing the accessway
must be re -vegetated as soon as feasible.
12. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned,
transferred, sold, or otherwise disposed of to a third -party.

Notice is hereby given that Albert L. Wiley, Jr. has applied to the Department of
Environment, Health and Natural Resources for a Minor Development permit. The applicant
is requesting to construct a house at lot 1, Tanglewood Ridge subdivision, adjacent to the
Atlantic Ocean, in the Town of Indian Beach.
Persons desiring to inspect the application, or to comment thereon, are directed to
contact , Jim Mercer, Division of Coastal Management, in the Marine Fisheries Building,
Morehead City, NC, Telephone (919) 726-7021, no later than August 4, 1994. Comments
received prior to that date will be considered in malting the permit decision. Later comments
will be accepted and considered up to the time of permit decision. Project modifications may
occur based on further review and comments. . Notice of the permit decision in this matter
will be provided upon written request.
