Dear Mr.. Payne::
We have reviewed the information submitted to this office in your inquiry
concerning the necessity of filing an application for a minor development
permit under the Coastal Area Management Act. The activity you propose is
exempt from needing a Elinor Development Permit, as long as it meets the condi-
tions specified below. If your plans should change and your project will no
longer meet those conditions, please contact me before proceeding.
A single-family residence must be located more than 40 feet landward of the
mean high-water mark, or normal water level, within the Estuarine Shoreline
Area of Environmental Concern. No land disturbing activity may occur within that
40-foot buffer zone other than construction of a 6-foot wide access to the water.
If the lot in question is in an eroding area, the house must be built the maximum
feasible distance back on the lot, but not less than 40 feet.
