Dear Mr. Parker:
We have reviewed the information submitted to this office in your inquiry
concerning the filing of an application for a Minor Development Permit,
under the Coastal Area Management Act for the construction of a pier and, or,
boat lift. This activity is exempt from needing a Minor Development Permit,
as long as it meets the conditions specified below:
A private, non-commercial pier/boatlift may be constructed, if:
it does not exceed two -hundred (200) feet in total length off -shore;
it is not within one -hundred fifty (150) feet of a federally main-
tained channel;
it does not extend beyond the four (4) foot mean low-water contour
line of the water body; nor beyond any neighboring existing pier;
it does not exceed six (6) feet in width;
it does not include an enclosed structure;
it does not interfere with established navigation rights.
It may be built through wetland vegetation, only if it is elevated.
The pier may be a T-head or platform, not to exceed two -hundred (200)
square feet in area at it's waterward end, if no wetlands are covered.
Any variation from the above will require a permit. Also, this certification�of
exemption from requiring a CAMA permit is valid for ninety (90) days from the date
of issuance. Following expiration, a re-examination of the project and project
site may be necessary to renew this certification.
