Issued to 91-97 rcrmn. ivumucr authorizing development in Emerald Isle at 113 Bouge Court, Block 53, Lot 23 as requested in the permittee's application dated June 7, 1991 This permit, issued on June 21, 1991 , is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and .notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. INLET HAZARD AREAS Inlet areas as defined by Ruel .0304 are subject to inlet migration, rapid and severe ch changes in watercourses,.flooding and strong tides. Due to this extremely hazardous natur of the inlet Ihazard areas, all development within these areas shall be located in accord- ance with the following standards: 1. All development in the inlet hazard area shall be set back from the first line of stable.vegetation a distance equal tothesetback required in the adjacent ocean hazard area, (150 feet). 2. Permanent structures shall be permitted at a density of no more than commercial or residental unit per 15,000 square feet of land area of lots subdivided or created after July 23, 1981; 3. Only residential structures of four units or less or non-residential structures of less than.5,000 square feet total floor area shall be allowedwithin the inlet hazard area: 4. Established common-law and statutory public rights of access to the public trust lands and waters in inlet hazard areas shall not be eliminated or restricted. Deve- lopment shall not encroach upon public accessways nor shall it limit the intended use of the accessways; 5. Shoreline stabilization structures shall be permitted only as a part of a publicly supported project; This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this . permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit require further written permit approval. All work must cease when this permit expires on DEC01BER_31, 19_94 — In i»uillg this permit it is agreed that this project is consis- tent with the local Land Use Plan and all applicable ordinances. AEC HAZARD NOTICE YOUR PROJECT IS IN AN: OCEAN ERODIBLE AREA HIGH HAZARD FLOOD AREA This notice is intended to make you, the appli- cant, aware of the special risks and conditions associated with development in this area, which is subject to natural hazards such as storms, erosion -or currents. The rules of the Coastal Resources Commission require that you receive an AEC hazard notice and acknowledge that notice in writing before any permit for development in this area can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are designed to minimize, but not totally eliminate, property losses from the hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate the area where f INLET HAZARD AREA This figure was established by careful analysis of aerial photographs of the coastline taken over the past 30 to 40 years. Studies also indicate that the shoreline could move as much as 60 feet landward in a major storm. The flood waters in a major storm are predic- ted to. be about._feet deep in this area. Preferred oceanfront protection measures are beach nourishment projects and relocation of threatened structures. Hard erosion protection structures such as wooden bulkheads, seawalls, rock and rubble revetments, wooden, metal, concrete or rock jetties, groins and breakwaters, concrete -filled sandbags and tire structures are prohibited. Shortly before work begins on the project site, the Local PermitOfficerwill determine the vegetation line and setback distance at that particular site. If the property has seen little change and the proposed development can still meet the setback requirement the LPO will inform you that you. may begin development It is important that you check with he LPO befon'ibe permit expires for official approval to continue work after your=permit expires. Gener- ally, if foundation pilings have been placed and substantial progress is continuing, permitrenewal may not be necessary.
