Mr;lean Enginsaring Aee0ciatQ2, we have learned of your plans to construct All approximate 100 fMot__1 road crossing through wetlands in order to gain access to your lot located at Bluewater Banks Subdivision, Lot .cumber 57, Carteret county, North Carolina. For the purposes of the Corps of Engineers, Regulatory program, Title 33, Code of Federal Regulations (m), Part 330, published in the Federal Rog' -star on November 13, 1986, lists nationwide permits. Authorization was provided for minor road crossing fill$ including all attendant features, both temporary and permanent, that area part of a single and complete project for crossing of a non -tidal waterbody, provided that the crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand expected high flows and provided further that diacyarges into any wetlands adjacent to the waterbody do not extend beyond 100 feat on either side of the ordinary high water mark of that waterbody. Your work is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. The nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid until the nationwide permit is modified, reissued, or revoked. All nationwide permits are scheduled to be modified, reissued or revoked prior to January 13, 1992. It is incumbent upon you to remain informsd of changes to the nationwide permits. Y1e will issue a public notice announcing changes when they occur. Any discharge of dredged or fill material will not occur in areas of concentrated shellfish production unless the discharge is directly related to a shellfish harvesting activity authorized by nationwide permit, 33 CFR 330.5(a)(4). c. The activity will not jeopardize a threatened or endangered species as identified under the Endangered Species Act, cr destroy or adversely modify the critical habitat of such-apeciea. d. The activity will not significantly disrupt the movement of those speeias of aquatic life indigenous to the waterbody (unlena the primary purpose of the fill is to impound water). a. Any discharge of dredged or fill material will consist of suitable material free from toxic pollutants. f. Any structure or fill will be properly maintained. g. The activity will not occur in a component of the National Wild and Scenic River System nor in a river officially designated by Congress as a "study river" for possible inclusion in the system. h. The activity will not cause an unacceptable interference with navigation. is if the activity may adversely affect historic properties which the National park service has listed on, or determined eligible for listing on, the .rational Register of Historic Places, or if significant historic properties are encountered before or during work, the permittee will notify the District Engineer. J. The construction or operation bf the activity will not impair reserved tribal rights, including, but not limited to, reserved water rights and treaty Fishing and hunting rights. k.
