and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Robert and Mary Gardner, authorizing development in the Estuarine Shoreline (AEC) at 420 Chestnut St., in
Swansboro, as requested in the permittee's application, dated October 30, 2005. This permit, issued on November 2,
2005, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a
fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: the construction of a single-family residence, domolition of an existing residence and a concrete driveway.
1) All proposed development and associated construction must be done in accordance with the revised work plat drawings dated
received 10130/05.
2) All applicable original permit conditions remain in effect. Any additional proposed change(s) to the approved revised plans for
development, construction, or land use activities will require a re-evaluation and further modification of this permit.
3) A copy of this permit modification shall be attached to the original permit and shall be posted or available on site. Contact this
office for a final inspection at (252)808-2808 at the completion of work.
This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project Ryan Davenport

Dear Mr. Davenport,
Please refer to our CAMA Minor development Permit (#06-03) wherein our
proposed home was situated approximately 75 feet from the water edge property line.
In order to make room for a side entry garage our builder needs 2 feet for garage
depth and 10 feet for driving turning radius. Accordingly, we request approval to move
the permitted footprint 12 feet closer to the water edge.
The existing permitted land area between the proposed house and the water is 75
feet x 60 feet or 4,500 sq. feet. A change from 75 feet to 63 feet would equate to 15.6 %
impervious surface area or a total of 700 square feet.
Please re-evaluate and approve the modification of this permit. The statements of
the adjacent riparian property owners are attached and both wholeheartedly agree with
the modification of this permit. Also, attached is approved site survey with the change
outlined in red.

This permit, issued on 03-28-03 is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes the construction of a single-family residence, demolition of an existing
residence, and a concrete driveway. The following conditions apply:
1. All proposed development and associated construction must be done in accordance with the
application dated 03/11/03, workplat drawing (s) dated 03/12103, and originally submitted on
03/14/03.
2. All construction must conform to the North Carolina Building Code requirements and all other
Local, State and Federal regulations.
3. Any change or changes in the plans for development, construction, or land use activities will
require a re-evaluation and modification of this permit.
4. The amount of impervious surface areas shall not exceed 30% of the lot area within 75' of the
normal high water contour/normal water contour, which defines the Coastal Shoreline AEC at
this location. In this case, 3.5% of impervious surface is authorized.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-

5. Pursuant to 15 NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or
otherwise disposed of to a third -party by the applicant, agent, or any entity other than the NC
Division of Coastal Management.
6. The development authorized under this permit must be accomplished a minimum of 30'
landward of the normal high water contour/normal water contour, maintaining this as a
vegetated buffer area.

Notice is hereby given that Mr. and Mrs. Robert Gardner has applied to the Department of
Environment and Natural Resources for a Minor Development permit. The applicant is requesting
to raze and reconstruct a residence on their property located at 420 Chestnut Street in Swansboro.
Persons desiring to inspect the application, or to comment thereon, are directed to contact
T. Barrett, Coastal Management Representative, NC Division of Coastal Management, 151-B
Hwy. 24, Hestron Plaza II, Morehead City, NC, Telephone (252) 808-2808, no later than March
27, 2003. Comments received prior to that date will be considered in making the permit decision.
Later comments will be accepted and considered up to the time of permit decision. Project

I have attempted unsuccessfully to contact Mr. and Mrs. Helms (adjacent property owners) via
telephone numerous times. I mailed the original of the enclosed letter to them today as indicated
by a U.S. Postal Service Delivery Confirmation Receipt ( a copy of which is also enclosed). The
Town of Swansboro has been notified both verbally and by hand delivery of a letter, of which a
copy has been provided for you.
It is my hope that the enclosed photographs will provide a sufficient description of the
vegetation and lot parameters to be disturbed.

I have discussed the new home footprint with Mary K and we both fee[ that this new construction is something we
want to do if we can situate the house 75 feet from the waterline ...... otherwise we lose the view. We are
hopeful that since the house is so n2rrow(355, CAMA may allow the minor enchroachment on the comers of the
house ..... and since we will be in conformance with the setback requirement at the center of the Iot....(over the past
20 years that we owned this property, we had always inviisioned our new home 75' from the water and we thought
the CAMA fine would be a straight line on this 60• lot). You and John Freshwater have my authorization to act as
my agent in this matter. Thanks for your help.

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.
PERMISSION TO ENTER ON LAND
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer
and his agents to enter on the aforementioned lands in connection with evaluating information related to this
permit application.
This application includes: general information (this form), a site drawing as described on the back of this application,
the ownership statement, the AEC hazard notice where necessary, a check for $100.00 made payable to the locality,
and any information as may be provided orally by the applicant. The details of the application as described by these
sources are incorporated without reference in any permit which may be issued. Deviation from these details will
constitute a violation of any permit. Any person developing in an AEC without permit is subject to civil, criminal
and administrative action.
