1. Permittee must take all necessary precautions to prevent any
sedimentation or foreign debris from entering any ditches, guts,
creeks, streams or bays.
2. Permittee must provide adequate ground cover to prevent any erosion
within 30 days of completion of the project.
3. Permittee must obtain all necessary building permits prior to
beginning construction.
4. This permit authorizes only the activity specifically mentioned on
the application and site drawing submitted for this permit.
5. Any further land disturbing activity may require additional permits
prior to beginning the activity.
6. Permittee must notify the L.P.O., upon completion of the project to
allow for inspection for compliance of the applicable Code regul-
ations, etc.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted underthis permit
must cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit, expires on

In issuing this permit it is agreed that this project is consis-
tent with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.

I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer
and his agents to enter on the aforementioned lands in connection with evaluating information related to this
permit application.
This application includes: general information (this form), a site drawing as described on the back of this ap-
plication, the ownership statement, the AEC hazard notice where necessary, a check for $50.00 made payable to
the locality, and any information as may be provided orally by the applicant. The details of the application as
described by these sources are incorporated without reference in any permit which may be issued. Deviation
from these details will constitute a violation of any permit. Any person developing in an AEC without a per-
mit is subject to civil, criminal and administrative action.

Dear Mr. Garner:
This letter is to inform you that the Architectural Control Committee of Creek
Pointe has received a request from Mr. Bill Donaldson (perspective purchaser of
Lots18 & 23 in Creek Pointe) to place a housing structure closer than 75' to the
mean high water mark. This request is done in accordance with rules and
regulations established by the Coastal Area Management Act which allows for
permits to be issued for residential structures within the 75' setback zone but no
closer than 40' to the mean high water mark. It is the intent of Mr. Donaldson to
comply with these rules and regulations.
After reviewing the request, the Architectural Control Committee sees no
problem with this; however, adjacent land owners are required to be notified and
we would like to receive any comment that you may have on this request.
Please let us hear from you as soon as possible in that we intend to grant this
variance to the covenants within 30 days.
