All proposed development and associated construction must be done in accordance with the permitted workplat drawing as originally submitted. 2. All construction must conform to the N. C. Building Code requirements and all other Local, State and Federal regulations. 3. Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. 4. The amount of impervious surface areas shall not exceed 30% of the lot area within the 75' Area of Environmental Concern. 5. Pursuant to 15A NCAC, Subchapter 71 .0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a,third-party. This permit action may be appealed by the permittee or other, qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit require further written permit approval. All work must cease when this permit expires on 12/31/95 In issuing this permit it is agreed that this project is consis- tent with the local Land Use Plan and all applicable ordinances. I object to the proposed structure and other development of the adjoining lot for a variety of reasons. Due to the size of the lot, the septic tank will be too near my well. I have concern that the lot would not meet the dimensional requirements for a aeptic tank if it did not include the end of Rice Ave. which is the river access area for other.property owners along Rice Ave. including myself. Frank Spain and wife Dalphines W. Spain in Florence N.C. off SR 1330 at the end of Rice Ave. On Dec. 20, 1991, I returned an unsigned Riparion Property owner statement with a certified letter of protest attached to Mr. Allen Propst, but it did not reach the inspection Dept. On Dec. 31, 1991, I mailed a certified letter to the Dept. of Environmental Health concerning the approval of a septic system that was too close to my well. Now I am informed that a conditional Minor Development Permit has been issued. Sub -paragraph six of this permit states that a signed statement showing no objection to the placement of the mobile home must be attained from R. Rice. Since I have a much longer boundry with the Spain property, why am I not being considered? I still feel the septic system is too close to my well and the placement of the mobile home will obstruct my view of the river. The Spain lot does no appear to meet the county space requirements in order to maintain the appropriate distance from the water. I request that NO waver be granted for this property. Unfortunately, do the circumstances of how this property was obtained by Frank Spain, from me, the fact tliat it is not being used as his original intent stated, and the ongoing discrepancys concerning a valid septic permit that has been revised to accomodate and/or adapt to the proposed land usage. I feel the following should be noted: As adjacent property owner and the twenty -foot recreational easement that is held and recorded in a deed to me and my heirs in "fee simple forever", located through the tract of land owned by Frank Spain, WE THE UNDERSIGNED, DULY NOTE: 1. Any attempt to change, install or extend sewer/water lines (or the like,) under or over the twenty -foot recreational easement that is recorded and legally held by me, Ms. Rosa Rice and heirs, to accomodate any present or future septic system for the aforesaid tract of land owned by Frank Spain will result in legal action being taken. It should be stressed that all interested parties should be certain that they have a viable septic system that meets State regulations as required. 2. Any attemptby any party to use that twenty -foot wide recreational easement described in a deed and held by me, Ms. Rosa Rice and heirs in "fee simple forever" that is located through the tract of land (.45 ac.) held by Frank Spain and recorded in Pamlico Co. N.C. Book 259 pg. 781 to obtain egress, ingress,to the aforesaid tract of land for the sole purpose of parking on, or obstructing the reserved recreational easement, does not meet the criteria of original intent and will result in our obtaining legal. -counsel. It is regrettable that we find it necessary to sign the forms sub'ect to the concerns as stated. This was necessary as a result of misleading and incon- sistent intent from Frank Spain.
