After reviewing your application in conjunction with the development standards
required by the Coastal Area Management Act (CAMA) and the DWQ Neuse River
Riparian Buffer rules, it is my determination that no permit may be granted for the project
you have proposed.
This decision is based on the fact that the proposed development is in direct
violation of the Neuse River Riparian Buffer Regulations. Also, the Division of Water
Quality has not waived these buffer regulations, nor have they granted a variance from
these rules. Your project calls for the majority of the proposed structure to fall within
Division of Water Quality's fifty -foot riparian buffer off of the Trent River. Should at
any time the Division of Water Quality waive or vary their regulations, your application
may be reconsidered for approval.
Should you wish to appeal my decision to the Coastal Resources Commission or
request a Variance from that group, please contact me so I can provide you with the
proper forrtts and any other information you may require. Appeal n must e

It has been brought to my attention that permit applications have been

Lower Neuse, the location listed above. I would like to express my serious concern for the

Upper Neuse, There are several issues that stand out when looking at the plot plan, and I feel

Stormwater/Sediment Control and the possibility for the introduction of

This is regarding the property at 246 Shoreline Drive and the opportunity for comments
regarding the request for Craven County building and CAMA permits. This property is = -
surrounded by water. On each side is a creek, one of which has a further pond set into the
property. The Trent River runs across the front. Most of the time, a small stream runs from the
Neuse River portion of the lot up into the property towards the pond. Most of the property is
wetlands. Most of the lot is covered with trees, brush, shrubs and water.
This property has been uninhabited for 25 years. Before that, we understand there was a house
built on "stilts" there, but it burnt down. This area is frequently [perhaps 20 times a year]
affected by wind tides. Many times, the property is inaccessible by the drive way and, in effect,
the entire property is predominately under water. In fact the two creeks on either side are
connected, as the drive onto the lot is completely submerged, making the lot an island or in
extreme water completely submerged. With these comments we are including the proposed plot
plan sent to us with the water areas shaded in blue, which makes it more evident the amount and
proximity of water surrounding this property.
First let us note for the record, that the rules for building in wetlands are not easy to come by for
the general public. Responses to our inquiries about the potential for building on the lot have
been confusing and inconsistent. We are referred to the CAMA website but it is not evident
where such rules exist there.
Next, the notification of intent to build at this lot raises serious questions and concerns.
We anticipate that any erosion on the property at 246 will likely increase erosion potential for
our own lot at 244. Naturally, we want to be assured that any building will not hasten or
contribute to erosion at 244, disturb the water quality of the river and surrounding water, or
further silt in the pond and creeks. Also, we want to be assured that any construction on 246 will
not affect our septic system or interfere with our well water.
Looking at the Proposed Plot Plan we will state the obvious that if the rules are enforced, the
buffer zones would obviously preclude any significant building on the uplands as identified on
the proposed plot plan. We are concerned that should a variance to the rules be permitted, the
process of building will disturb the wetlands, the habitat and the quality of water around the lot
due to erosion, runoff and other effects of building.
Since we have been here, we believe the land at 246 has already experienced substantial
shoreline erosion, particularly as a result of the several hurricanes we have had in recent years,
but also the frequent windtides. What stipulations are there for maintaining the trees, bushes and
shrubs on the lot to protect the lot from further erosion?
We note that as part of the building fill is intended. The square footage of the house and fill area
looks substantial. (We calculate that it is being proposed to fill about a 7000 square foot surface
area.) What is the height of the fill?? If it is being proposed to fill to the foundation of a new
house which will be above the high water mark, that will probably be 8 to 10 feet above the
existing level. Because of the small area of land, it would seem necessary that the whole
"upland" would be built up. This is hard to envision -something like a small hill. Is there a huge
retaining wall proposed? Further, we wonder if fill is expected along the drive, because as we

process and guarantees are available to assure that this substantial amount fill will not run into
the creeks and river? How is it possible to contain so much fill in the proximity of the wetlands,
creeks and rivers during construction, given frequent wind tides, etc? Is there any room around
the construction site to allow grading and filling equipment to operate without further damage to
the shoreline?
What protection is proposed for the effect of water flow off the roof? It looks like a 3500 square
foot structure is being proposed. Such water flow can also contribute to erosion.
The access to the proposed building site is along the long narrow gravel drive noted on the
proposed plot plan. There are no obvious buffer zone lines drawn on that part of the plot but it
is obvious that the drive is only a few feet from the creeks. We are concerned about the
removal of trees and erosion resulting from equipment in the act of construction and the
placement of electricity, septic and water lines.
We are concerned about the placement of the septic system. Where is the septic system to go,
given the setback requirements from the road for the River Bend community and the buffer
zones of the two water ways? Most certainly it cannot be located so close to the buffer zones
because of the likelihood of effluent contaminating the water, therefore, we assume it will be
pumped into another part of the lot, closer to the road. How will this pumping system be
constructed without disturbing the buffer zone since it would have to built in the buffer zone??
Is it proposed that the new structure be connected to city water? Again the opportunity for
erosion and destruction of buffer zone area seems substantial.
While we are not experts on reading the survey document, we find the exact location of the
buffer zones confusing. According to the proposed plot plan, there are two 30 foot buffer zone
lines (one for Cama and one for Neuse River). These appear at 2 separate points on the map.
In the drawing, the wetlands and creek in the middle of the property seem to have no bearing on
the location of the buffer zone as drawn on the proposed plot line. Are they not to be
considered?
If a variance is granted, we would like to be informed the reason and rationale.
What does it actually permit? Does it mean that there is no restriction on removal for the trees
and shrubbery in the buffer zones, as long as it is deemed `necessary" for building the structure?
Is there any mitigation possible to offset the damage caused by building.

The North Carolina Division of Coastal Management hereby acknowledges receipt of
your application for state approval for minor development of the property located at 246
Shoreline Drive in River Bend in Craven County. It was received on June 14, 2005 and
appears to be adequate for processing at this time. The projected deadline for making a
decision is June 27, 2005,
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a copy of the "Notice of Permit Filing"
postcard which must be posted at the property of your proposed development. You
should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be; Nailing the notice card to a
telephone pole or tree along the road right -of way fronting the property, or at a point
along the road right-of-way where a private road would Iead one into your property.
Failure to post this notice could result in an incomplete application. Considering your
current home being out of state, I will post this notice on site on your behalf.
An onsite inspection will be made, and if additional information is required, you will be
notified. Please contact me if you have any further questions or concerns.

CAMA permits in Areas of Environmental. Concern, hereby gives NOTICE that on June
