State Dredge_ and Fill Law, for.you to proceed` with your project proposal. Please sign bath the original (buff -
colored form) and the copy. Return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below. Please retain the original (buff -colored
form), as it must be available on, site when the project is inspected for compliance.
If you object to' the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 ors 113-229. Your petition for a hearing must be filed in accordance with.NCGS Chapter 150B.with the Office

issued'on 1 /24/07, is subject to compliance with the application and site drawing (where consistent with the '
permit), all applicable regulations and'special conditions and notes set forth below. Ariy violation of these
terms may subject permittee*to a fine, imprisonment or civil action, or may cause the permit to be null and
void.
This permit authorizes shoreline stabilization above all marsh and the. normal water level. Any.other
development will require additional permits or a modification of this permit. The following conditions
shall apply:
(1) All proposed development and associated construction must be done in accordance with the
application dated 8/14/03, renewal request dated 12/12/06, and workplat drawing(s) dated 8/5/03.
(2) All construction must conform to the N.C. Building Code requirements and all other Local, State and
Federal regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a
re-evaluation and modification of this permit.
(4) Prior to initiating and land -disturbing activities, adequate sedimentation/erosion control measures must
be. employed to prevent the movement of unconsolidated materials into the marsh or water., These
measures will remain in place until such time as the area has been properly stabilized with a vegetated
cover.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
AII work must cease when this permit expires on
December31, 2008
In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management.

otherwise disposed of to a third -party by the applicant, agent, or any entity other than the NC Division
of Coastal Management.
(6) It is noted that coastal marsh.exists on the property, and that the proposed development. addressed on
the submitted plat dated 10/14/03. is not located within this marsh.
.(7) No excavation of filling of any wetlands or waters is authorized under this permit. .
(8) Any. development or'land disturbing activity, that is. considered non -water dependent is, not authorized
within 50 feet of the normal high/normal water level unless specifically exempted by Environmental
Management Commission (EMC) Neuse River buffer regulations in place at the time of such
development.
(9) The LAMA alignment staked 7/29/03 is valid for 90 days. After this 90 days period the alignment
will need to be re -staked before contractor commences.
(10) The authorized walkway to the base of the shoreline stabilization should be slatted and drip through
and not exceed 6 feet in width.
(11) A'copy of this permit shall be available onsite for regulatory inspection.

and productive areas that border the state's sounds and oceanfront. Along
with requiring special care by those who build and develop the General
Assembly directed theT Coastal Resources Commission (CRC) to imple-

Dear Mr. Smith:
The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for minor development of your property located at 680 Smith Farm Road in
Havelock adjacent to Clubfoot Creek in Craven County. It was received complete on August 14,
2003 and appears to be adequate for processing at this time. The projected deadline for making a
permit decision is August 28, 2003.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be notified.

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner is aware that the proposed development is planned for an area which may be susceptible to
erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular hazard problems associ-
ated with this lot. This explanation was accompanied by recommendations concerning stabilization and floodproofing tech-
niques.
PERMISSION TO ENTER ON LAND:
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer and his agents to
enter on the aforementioned lands in connection with evaluating information related to this permit application.
This application includes: general information (this form), a site drawing as described on the back of this application, the
ownership statement, the AEC hazard notice where necessary, a check for $100.00 made payable to the locality, and any infor-
mation as may be provided orally by the applicant. The details of the application as described by these sources are incorporated
without reference in any permit which may be issued. Deviation from these details will constitute a violation of any permit. Any
person developing in an AEC without permit is subject to civil, criminal and administrative action.
