This permit, Issued on —1 is subject to compliance with the application and she drawing (where consistent
with the permit), all applicable regulations and special conditions and notes setforth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
***This permit authorizes the application of fill material to achieve positive drainage and the
construction of an in -ground swimming pool. Any other development will require additional permits
or a modification of this permit The following conditions shall apply:
1. Ail proposed development and associated construction mast be done in accordance with
the application dated 10/29/03 and work drawlogs submitted on 10/29/03.
2. All construction most conform to the NC Building Code requirements and all Local,
State, and Federal regulatiioua.
3. Any change or changes in the plant for development, construction, or land we activities
will require a re-evaluation and modification of this permit
4. Pursuant to 1 SA NCAC 07J.0406(b)y this permit may not be assigned, transferred, sold,
or otherwise disposed of to a third party by the applicant, agent, or any entity other than
the NC Division of Coastal Management-
S. No excavation or filling of any wetlands or waters is authorized under this permit.
6. This project is located in the Meuse River Basin and is subject to the EMC's Neese River
Riparian Buffer Regulations. Contact Tom Steffens with NC Division of Water Quality
at (252) 9464UI for approval prior to project initiation.
7. Construction of swimming pool may not begin without the property owner first being
granted a variance from the Division of Water Quality to develop within the Riparian
Buffer ,Zone.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under thls per-
mit m.st cease until the appeal is resolved_
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December
31, 7.02 0
In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

I acknowledge that the land owner is aware that the proposed development is planned for an arcs which may be susceptible to
erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular hazard problems associ-
ated with this lot. This explanation was accompanied by recommendations concerning stabilization and floodproofing tcch-

The North Carolina Division of Coastal Management hereby acknowledges receipt of
your application for state approval for minor development of the property located at 206
Bridgepoint Drive in Craven County. It was received on 10-29-03, and appears to be
adequate for processing at this time. The projected deadline for malting a decision is 11-
23-03.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post
this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree
along the road right-of-way fronting the property, or at a point along the road right-of-
way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be

Pursuant to NCGS 113-119(b), Craven. County, a locality authorized to issue
CAMA permits in Areas of Environmental Concern, hereby gives NOTICE that on 10-
29-03, Michael Hawkins applied for a CAMA permit for the placing and re -vegetating of
fill material and the construction of a swimming pool with associated decking at 206
13ridgepoint Drive.
The application may be inspected at the address below. Public comments
received by 11-13-03 will be considered. Later comments will be accepted and

Dear Mr. Hawkins,
This letter confirms that I observed the activities taking place at 206 Bridgepoint
Drive (Craven Co. parcel # 7-002-029) in the City of New Bern along the Trent River, in
Craven County, NC, on 10-14-03, to investigate the possibility of development activity in
an Area of Environmental Concern (AEC) without proper authorization. My
observations verified that considerable excavation in the rear of the property along the
Trent River is under way. No minor permit has been issued for this development activity.
No person may undertake activity constituting minor development within a
designated AEC without first obtaining a Minor Development Permit from the North
Carolina Department of Environment and Natural Resources or a Local Government
with an approved Coastal Management Implementation and Enforcement Program. This
requirement is imposed by North Carolina General Statutes (NCGS) 113A-118.
You are hereby requested to STOP WORK IMMEDIATELY and contact this
office by 10-21-03 to file the necessary application. NO WORK MAY PROCEED
UNTIL THE PERMIT IS ISSUED. If you comply voluntarily, no further action will be
necessary beyond restoration of any damaged natural resources protected by the Act,
whatever project modification are needed to bring your development into compliance
with the Act and the issuance of a permit.

Failure to file an application or continuation of work after receipt of this Notice
may constitute a violation of the Act and you may face civil and/or criminal penalties as a
result. Each day the development continues, or is repeated after receipt of this Notice,
may constitute a separate violation and could result in further penalties or imprisonment
for not more than sixty (60) days or both (NCGS 113A-126).
