The NC Division of Coastal Management hereby acknowledges your August 29, 1997
letter in which it was requested that the Coastal Area Management Act Minor Development
application to construct a "Hatteras Style" beach ramp be placed in abeyance until the Town
resolves the matter of a contract agreement with Mr. McConkey, III. Based on this request,
processing of the Town's application will be terminated until such time that you request a
resumption of application processing and the requested survey showing property boundaries and
proposed ramp location is provided. As required by NCAC T15A:07J.0204(d), during the
pendency of any termination of processing, the permit processing period will not run. Upon
receiving the requested survey and a request to re -initiate processing, the Division will resume
processing of the application at the point where it was terminated.

This letter is with reference to your application for a Coastal Area Management Act
Minor Development permit to construct a "Hatteras Style" beach ramp adjacent to the Iron
Steamer Resort, in the Town of Pine Knoll Shores, Carteret County. Although processing of
the application is nearing complete, additional time is needed for this office to complete the
review and make a decision on you request. Therefore, it is necessary that the standard review
time be extended. The time period within which a final decision shall be made has been
extended an additional twenty five days pursuant to NCGS 113A-121(b).
Also, during our telephone conversation of earlier in the week, a question arose as to the
exact location of the property lines. And as you recall, at that time I requested that a survey be
provided to this office to settle any property dispute regarding the project's permitability. At
this time, no such survey has been provided: We will continue to review the application through
next week. However, if at that time, the survey is not available we will place the application
on hold pending its submittal. Thank you for your cooperation and if you have any questions
regarding this matter, please don't hesitate to contact me at my Morehead City Office (919-808-

Our office recently received notification from the Town of Pine Knoll Shores that they were
seeking approval for a Minor CAMA Permit to construct a (Hatteras Style) beach ramp
adjacent to the Iron Steamer Resort.
The Board of Directors for Beachwalk Homeowners Association, requests that before the
CAMA Permit is approved, that the Town of Pine Knoll Shores have the property surveyed to
ensure that they do not infringe on Beachwalk's property. The Board also requests that some
assurance be given by the Town of Pine Knoll Shores, that this ramp will not be open to public
use in the future.

AGREEMENT
COUNTY OF CARTERET
This Agreement, dated for purposes of reference July 14, 1997, is made by and between
the Town of Pine Knoll Shores, a North Carolina Municipal Corporation (hereinafter "the
Town.' and Samuel A McConkey, Sr. (hereinafter "McConkey"), record owner of that property
known as the Iron Steamer Pier and. Motel (hereinafter "Iron Steamer"), being situatcd'within the
limits of the Town.
BACKGROUND STATEMENT
The Town, located on Bogue Banks, currently does not have adequate beach access for
the dispatch of Police and/or Emergency Medical Services (hereinafter "EMS") vehicles when
needed thereon.
As owner of the iron Steamer Pier and Motel, which fronts the beach, McConkey desires
to make a portion of the premise available in order to provide access for the Town's dispatch of
said vehicles.
In connection therewith, the parties have indicated their willingness to enter an agreement
granting the Town limited use of 1McConke3's property.
STATEMENT OF AGREEMENT
For consideration in the sum of Five Hundred Dollars ($500.00), payable by the Town to
McConkey, the parties hereby agree as follows:
1. The Town will, at its sole expense, install and maintain a "Hatteras ramp"
measuring approximately 10 feet in width and 60 feet in length on the east side of the Iron
Steamer Motel, for the limited purpose of providing beach access for the Town's Police and
EMS vehicles when necessary. The Town may make further use of the ramp for sand pushing
equipment from time to time. This access will not be available to the general public.

2. McConkey will also make available, and dedicate to the exclusive use of the
Town, a parking space to accommodate an EMS vehicle, which vehicle shall be permitted to
park in said space for the duration of this Agreement.
3. This Agreement shall be in effect for a period of one year measured from the bate
above written, but may be extended for consecutive periods of one year by the mutual consent of
both parties, and upon the Town's payment of additional consideration in the sum of Five
Hundred Dollars ($500.00) per year.

of Environment, Health and Natural Resources for a Minor Development permit. The applicant
is requesting to construct a Hatteras -style beach access ramp for emergency vehicles.
Persons desiring to inspect the application, or to comment thereon, are directed to contact

appears to be adequate for processing at this time. The projected deadline for making a decision
is August 14, 1997.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be

FOR DEVELOPERS IN OCEAN HAZARD AND ESTUARINE HAZARD AREAS:
I acknowledge that the land owner is aware that the proposed development is planned for an area which may
be susceptible to erosion and/or flooding. I acknowledge that the local permit officer has explained to me the
particular hazard problems associated with this lot. This explanation was accompanied by recommendations
concerning stabilization and floodproofing techniques.
PERMISSION TO ENTER ON LAND
I furthermore certify that I am authorized to grant and do in fact grant permission to the local permit officer
and his agents to enter on the aforementioned lands in connection with evaluating information related to this
permit application.
This application includes: general information (this form), a site drawing as described on the back of this ap-
plication, the ownership statement, the AEC hazard notice where necessary, a check for $50.00 made payable to
the locality, and any information as may be provided orally by the applicant. The details of the application as

SITE DRAWING/APPLICATION CHECKLIST
Please make sure your site drawing includes the following information required for a CAMA minor develop-
ment permit. The drawing may be simple and not necessarily to scale. The Local Permit Officer will help you,
if requested.
PHYSICAL DIMENSIONS
label roads
label highways right of ways
label local setback lines
label any and all structures and driveways currently existing on property
PHYSICAL CHARACTERISTICS
draw and label mean high water mark (MHW)
draw location of septic tank or filter field
If you will be working in the ocean hazard area:
draw and label dune ridges (note height)
draw and label toe of dune
identify and locate first line of stable vegetation
draw and label setback line under CAMA
draw and label topographical features (optional)
If you will be working in an estuarine shoreline area:
draw and label landward limit of AEC
describe terrain (slope)
DEVELOPMENT PLANS
draw and label areas that will be disturbed
if a house is to be placed on lot, describe location of house
note size of pilingg and depth to be placed in ground
draw and label all areas to be paved or graveled
describe composition of surface
note and list fully all trees and vegetation to be removed or relocated
show landscaping
