We have reviewed the information submitted to this office in your inquiry concerning the necessity of filing an
application for a minor development permit under the Coastal Area Management Act (CAMA). The activity you
propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If
your plans should change and your project will no longer meet those conditions, please contact me before
proceeding.
DESCRIPTION OF ACTIVITY AND CONDITIONS:
Boat Moores Neat U tsl: 7K.0203(c) and Chapter 16: Waterways. PKS Ordinance
A boat lift is defined as an uncovered structure for the propose of lifting or moving a boat. There shall be no root cover, top, or deck placed or
constructed over the boat lift. The boat lift must not extend more than one-third of the way across the water body and shall not interfere with
established navigation rights. The boat lift must be for private, non-commercial use only. The boat lift must be set back a minimum of 15' from the
adjacent property owner's area of riparian access unless waived by a written agreement. Confirmation must also be given that written statements
have been obtained indicating that they have no objections to the proposed boat lift.
No structure shall be allowed that, in its normal operation, shall allow a boat to be stored or docked, either in or above the water, within 20 feet of
the center of the waterway in which the structure is located Pilings and boat moving devices shall not be more thh=20 feet in length measured to the
parallel riparian lot line. No structure for the purpose of assisting in boat dockage or boat storage, such as one or more pilings, a davit or a boat lift,
shall be permitted in addition to the allowed dock or pier appurtenant to any lot unless said structure is appurtenant to said allowed dock or pier,
and is constructed so as to be utilized to assist in the docking or storage of boats on or at said dock or pier. If the 15 feet setback is waived by the
adjacent riparian property owner. neither the dock or pier, pilings, or other structures shall extend closer than 5 feet from the adjacent lot line.
You have been approved to construct an open boat lift and boardwalk at 102 BoSw Pines Circle, in Bogue Pines Basin Pine Knoll Shores, Carteret
County, NC, as per the approved plans dated 04-27-95. Any change in plans shall be approved by Local Permit Officer/Building Inspector prior to
commencing work.

BOAT LIFT AGREEMENT
This agreement, made this day of f, month 01S year
between Bogue Pines Property Owners Association and
owner of lot '�"� located in Bogue Pines Court, Pine Knoll Shores, N. C.
The Above Parties Hereby Agree
1. The boat basin and dock area is owned by the Bogue Pines Property Owners
Association.
2. All boat lift plans must be approved by a committee of 3 people who own
property in Bogue Pines. The initial committee will be Harold Blackley,
John Sears and Jack Stancil. The boat docking area belongs to all
property owners; therefore, it is important that the beauty and aesthetics
of this area be maintained.
3. Boat lifts should be installed to conform to looks and type of the other
boat lifts in the common area including height of lift.
4. Unsightly guide poles, pilings, boardwalk extensions, etc. will not be
allowed.
5. Dock lockers, etc. are not allowed in the boardwalk or any other part of
the common area.
6. All electrical hook-ups for the lift motors must be done by a licensed
electrician.
7. All maintenance to the boat lifts shall be the responsibility of the above
lot owner.
8. The lot owner agrees that if there is a violation of this agreement and if
it is not corrected by the lot owner within 30 days, the property owners
association has the right to correct the violation and charge the lot
owner for any expense incurred by the property owners association.
9. Neither Bogue Pines Property Owners Association or any of the other lot
owners will assume any liability or responsibility for any property damage
or bodily injury.
10. This agreement will be binding on subsequent owners of this lot.
In witness thereof, the parties hereto have caused this agreement to be
executed as of the day and year first written above.
