We have reviewed the information submitted to this office in your inquiry concerning the necessity of filing an
application for a minor development permit under the Coastal Area Management Act (CAMA). The activity you
propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If
your plans should change and your project will no longer meet those conditions, please contact me before
proceeding.
DESCRIPTION OF ACTIVITY AND CONDITIONS:
Boat Mooring [boat lifts]: 7K .0203(c) and Chanter 16: Waterways. PKS Ordinance
A boat lift is defined as an uncovered structure for the purpose of lifting or moving a boat. There shall be no roof, cover, top, or deck placed or
constructed over the boat lift. The boat lift must not extend more than one -thud of the way across the water body and shall not interfere with
established navigation rights. The boat lift must be for private, non-commercial use only. The boat lift must be set back a minimum of 15' from
the adjacent property owner's area of riparian access unless waived by a written agreement. Confirmation must also be given that written
statements have been obtained indicating that they have no objections to the proposed boat lift.
No structure shall be allowed that, in its normal operation, shall allow a boat to be stored or docked, either in or above the water, within 20 feet
of the center of the waterway in which the structure is located. Pilings and boat moving devices shall not be more than 20 feet in length
measured to the parallel riparian lot line. No structure for the purpose of assisting in boat dockage or boat storage, such as one or more pilings,

allowed dock or pier, and is constructed so as to be utilized to assist in the docking or storage of boats on or at said dock or pier. If the 15 feet
setback is waived by the adjacent riparian property owner, neither the dock or pier, pilings, or other structures shall extend closer than 5 feet
from the adjacent lot line.
You have been approved to construct an open boat lift at 108 Teak Court, in Davis Landing, Pine Knoll Shores, Carteret County, NC, as per
the approved plans dated September 21,1995. Any change in plans shall be approved by Local Permit Officer/Building Inspector prior to
commencing work.

PIERS • 7K 0203 and Chapter 16• Waterways, Pine Knoll Shores Ordinances
A private, non-commercial pier may be constructed if it does not exceed 200' in total length offshore; is not within
150' of a federally maintained channel, does not extend beyond the 4' mean low water contour line or normal water
level, (whichever is applicable) of the water body; does not exceed 6' in width; does not include an enclosed
structure; and, does not interfere with established navigation rights. It may be built through wetland vegetation only
if elevated and may have a T-head or platform not exceeding 500 sq. ft. in area at its water ward end if no wetland
areas are covered. The pier must be set back a minimum of 15' from the adjacent property owner's area of riparian
access unless waived by a written agreement. Confirmation must also be given that written statements have been
obtained from adjacent riparian property owners indicating that they have no objections to the proposed pier. The
pier shall not extend beyond the established pier length along the same shoreline for similar use, and in no case,
extend more than one-third (1/3) of the width of the water body and shall not interfere with shellfish franchises or
leases. Also, piers authorized by this exemption shall be for 1he exclusive use of the landowner, and shall not
provide rented or leased docking space or any other commercial services. Piers and mooring facilities designed to
provide docking space for more than four (4) boats shall, because of their greater potential for adverse impacts, be
reviewed through the permitting process, and are, therefore, not authorized by this exemption.
Docks or piers constructed in the canal waterway or basins may be constructed if the upper deck surface does not
extend no more than the greater of 4 feet above the mean high water mark, or the maximum height of the adjoining
seawall. Neither the dock, pier, nor appurtenant structures (including pilings and boat moving devices), shall be
more than 20 feet in length measured to the parallel riparian lot line. The width of the dock or pier shall not exceed
6 feet in width. If the 15 feet setback requirement is waived by the adjacent riparian property owner, neither the
dock or pier, pilings, or other structures shall extend closer than 5 feet from the adjacent property lot line. No
structure shall be allowed that, in its normal operation, shall allow a boat to be stored or docked, either in or above
the water, within 20 feet of the center of the waterway in which the structure is located. No structure for the purpose
