The activity you propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If your plans should change and your project will no longer meet those conditions, please contact me before proceeding. DESCRIPTION OF ACTIVITY AND CONDITIONS: STRUCTURAL ACCESSWAYS OVER FRONTAL DUNES: (7K .0207) Structural pedestrian accessways over frontal dunes must not exceed six (6') feet in width and may not be for commercial or motor -powered vehicular use. The access way shall be constructed over the frontal dune without any alteration of the dune beyond the driving of pilings. Any vegetated are that are disturbed shall be re -vegetated as soon as feasible. Every beach access way shall be constructed of durable wood, and shall remain unpainted. Each access way must be constructed on posts or pilings sunk to a depth of no more than five (51) feet, and only the posts or pilings shall be in contact with the dune. Floor planks shall be spaced to allow water, light, and sand passage. Construction shall minimize visual obstruction by eliminating solid siding or roofing. The platform overlook shall not exceed one hundred sixty (160) square feet in size on. single family residential lots, or four hundred (400) square feet in size on any other parcel. The floor of the platform overlook shall be no more than three (3') feet above the natural crest of the dune. The step system shall intrude onto the beach only as required to minimize contact with the seaward face of the dune. The step system shall be promptly relocated upon substantial erosion or accretion of the frontal dune. Should any platform overlook be destroyed as to at least one-half (M) of its square footage, such platform overlook, and all steps leading thereto, shall not be reconstructed without the issuance of a building permit, and until it conforms with the standards imposed by this exemption. As per the approved plans dated 09-05-95, you have been approved to construct an access way dune deck 11' x 14' at 111 Dogwood Circle, Pine Knoll Shores, NC.
