Pacre authorizing development in _ Ocean hazard AEC at_107 Pinewood Dr., PKS, NC as requested in the permittee's application dated April 11, 1995 This permit, issued on April 24, 1995 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. Any structure shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) yeas of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at the time. This condition shall not affect the permit holders right to seek authorization of temporary protective measure allowed under 7H .0308[a][2]. Any building constructed within the Ocean Hazard Area shall comply with the North Carolina Building Code including the Coastal and Flood Plain Construction Standards, Chapter 27, Volume M and the Pine Knoll Shores Flood Damage Prevention Ordinance as required by the National Flood hwa=ce Program If any provision of the building code or a flood damage prevention ordinance is inconsistent with any ofthe AEC samdards, the more restrictive provision shall control. The permitted development and associated construction shall be undertaken in accordance with the approved workplat drawing dated 4/11/95. All construction activities shall conform to all Pine Knoll Shores, State, and Federal ordinances and regulations. All development authorized by this permit (i.e. the house) trust be designed and situated on the property so as to minimize damage due to fluctuations in ground elevation and wave action in a 100-year storm. The permitted house must be set back at least 60, feet firom the first line of natural stable vegetation as identified by the CAMA Permit Officer. The permittee and/or the contractor is required to contact the Local Permit Officer shortly before beginning construction to arrange a set back measurement which will be effective for sixty (60) days barring a major shoreline change. Construction mu begin within this sixty (60) day period or the measurement is void and must be re established. See m ff!ement page for other rpplicable regulations, special conditions and notes pertaining to the proposed development and associated construction. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted underthis permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on December 31, 1998 In issuing this permit it is agreed that this project is consis- tent with the local Land Use Plan and all applicable ordinances. The house to be constructed in the Ocean Hazard Area shall be constructed on a pile foundation. Round timber piles shall not be less than 8" in diameter, or square timber piles shall not be less than 8" square, nominal. All pilings within the Ocean Hazard Area shall have a tip penetration of at least 5.0' below mean sea level or 16' below average original grade whichever is least. The sills and joists of the lowest floor must meet the 100 year flood level elevation of 16' feet MSL. 10. The structural accessway must not exceed six (6') feet in width. 11. The structural accessway must be raised on posts or pilings of 5' or less in depth so that only the vertical supports come in contact with the frontal dune. 12. Any areas of vegetation that are disturbed in the course of constructing the accessway must be revegetated as soon as feasible. 13. Pursuant to 15 NCAC, Subchapter 7J .0406(b), this permit may not be assigned, transferred, sold, or otherwise disposed of to a third -party. DEVELOPMENT PERMIT In 1974, the North Carolina General Assembly passed the Coastal Area Management Act and set the stage for guiding development in the fragile and productive areas which border s atpe's sounds and oceanfront. Along _ with r s ecial care by those who build and develop, the General`Assembly directed the Coastal Resources Commission (CRC) to implement clear regula- tions which minimize the burden on the applicant. This application for a minor development permit under CAMA is part of the Commission's effort to meet the spirit and intent of the General Assembly. It has been designed to be straightforward and require no more. time or effort necessary from the applicant. Please go over this folder with the Local Permit Officer (LPO) for _ the locality, in which you plan to build to be certain that pT AL P you understand what information he or she needs. APR " 1 �y9 ! Under LAMA regulations, the minor permit is to be issued within 25 days once a complete application is in _ hand. Often less time is needed if the project is simple. The process generally takes about 18 days. Other permits are sometimes required for development in the coastal'area. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are designed to minimize,but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is ..9—_ feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as 60 feet landward in a major storm. The flood waters in a major storm are predicted to be about / feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. Without the proper signature, the application will not be complete. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer will determine the vegetation line and setback distance at your site. If the property has seen little change and the proposed development can still meet the setback requirement, the LPO will inform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary. If substantial progress has not been made, the permit must be renewed and a new setback line established. It is unlawful to continue work after permit expiration without this approval.
