The structure must be set. back 105 feet from the first line of stable natural vegetati . The structure must be located entirely off of the frontal dune, and, if a primary dune is present, behind the crest of the primary dune. . The structure must be elevated on pilings with a diameter of at least eight (8) inches and the first ,floor level of the sills and joists must meet the minimal 100-year flood as required by FIRM Community -Panel # 370047-0001C. If the structure is located closer than 60 times the annual erosion rate from the most seaward line of stable natural vegetation, all pilings shall have a tip penetration of at least five (5) feet below mean sea level, or sixteen feet below average original grade, whichever is least; if located on a primary dune, the tip penetration must be at least five (5) feet below mean sea level. No impermeable surfaces shall be allowed over any functional part of the septic tank system. Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is not weakened or reduced. Disturbed areas will be immediately stabilized. This permit may be renewed for one year, if requested before the.expiration date. (Continued on page two) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted underthis permit must cease until the appeal is resolved. - This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. All work must cease when this permit expires on DECEMBER 31, 1998 In issuing this permit it is agreed that this project is consis- tent with the local Land Use Plan and all applicable ordinances. The permittee is required to contact the Local Permit Officer shortly before he plans to begin construction, to'arrange setback measurements which will be effective for 60 days, barring a major shoreline change. 9. Sand used to strengtht�n dunes must be brought in from an outside source and must be of the same nature as the sand in the area in which it is to be placed. No sand is to be removed from the lot. 10. Sand held .in storage in any dune other than frontal or primary dunes may be moved laterally in order to strengthen existing primary or frontal dunes if the work would enhance .the protection to the proposed development activity and the sand is immediately established. 11. Any structure shall be relocated or dismantled when it becomes imminently threatened by the changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time When it becomes imminently threatened, and in any case, upon its collapse or suidenc e. However, if natural shoreline recovery or beach nourishment take place within two (2) years of the time and structure become imminently threatened, so that the structure is no longer imminently threatexied, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holders right to seek authorization of temporary protective measure allowed under 7H.0308(a)(2), (15A NCAC 7H.0306(1)). The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alteration are designed to minimize,but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean eros� rate for the area where your property is located is —feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as—!T-O feet landward in a major storm. Tly flood waters in a major storm are precicted to be allow t feet deep in this area. Preferred oceanfront protection measures are _ mcn nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sandbags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. Permits issued for developmentin this area expire on December 31 of the third year following.the year in which the permit was issued. Shortly before work begins, on the project site, the Local Permit Officer will determine the vegetation line and setback distance at your site. If the property has seen little change and the proposed development can still meet the setback requirement, the LPO will inform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary.
