We have reviewed the information submitted to this office in your inquiry concerning the necessity of filing an
application for a minor development permit under the Coastal Area Management Act (LAMA). The activity you
propose is exempt from needing a minor development permit as long as it meets the conditions specified below. If
your plans should change and your project will no longer meet those conditions, please contact me before
proceeding.
DESCRIPTION OF ACTIVITY AND CONDITIONS:
PIERS: 7K .0203 and Chapter 16: Waterways, Pine Knoll Shores Ordinances ,
A private, non-commercial pier may be constructed if it does not exceed 200' in total length offshore; is not within
150' of a federally maintained channel, does not extend beyond the 4' mean low water contour line or normal water
level, (whichever is applicable) of the water body; does not exceed 6' in width; does not include an enclosed
structure; and, does not interfere with established navigation rights. It may be built through wetland vegetation only
if elevated and may have a T-head or platform not exceeding 500 sq. ft. in area at its water ward end if no wetland
areas are covered. The pier must be set back a minimum of 15' from the adjacent property owner's area of riparian
access unless waived by a written agreement. Confirmation must also be given that written statements have been
obtained from adjacent riparian property owners indicating that they have no objections to the proposed pier. The
pier shall not extend beyond the established pier length along the same shoreline for similar use, and in no case,
extend more than one-third (1/3) of the width of the water body and shall not interfere with shellfish franchises or
leases. Also, piers authorized by this exemption shall be for the exclusive use of the landowner, and shall not provide
rented or leased docking space or any other commercial services. Piers and mooring facilities designed to provide
docking space for more than four (4) boats shall, because of their greater potential for adverse impacts, be reviewed
through the permitting process, and are, therefore, not authorized by this exemption.
If the 15 feet setback requirement is waived by the adjacent riparian property owner, neither the dock or pier, pilings,
or other structures shall extend closer than 5 feet from the adjacent property lot line. No structure shall be allowed
that, in its normal operation, shall allow a boat to be stored or docked, either in or above the water, within 20 feet of
the center of the waterway in which the structure is located. No structure for the purpose of assisting boat dockage or
storage, such as one (1) or more piles, a davit or a boat lift, shall be permitted in addition to the allowed dock or pier
appurtenant to any lot unless said structure is appurtenant to said allowed dock or pier, and is constructed so as to be
utilized to assist in the docking or storage of boats on or at said dock or pier.
As per the approved plans dated 519195, you have been approved to construct a N wide pier, approximately 35'
offshore from the MHW mark, with a 16' x IN T-head dock on the end, at 532 Pelican Drive, in Bogue Sound, Pine
Knoll Shores, Carteret County, NC. Any change in plans shall be approved by the Local Permit Officer/Building
Inspector prior to work commencing.

Dear neighbor:
Now that we have finished our house on Pelican Point, we are planning on building a dock.
It is necessary to have permission from adjacent property owners as part of the requirments
of the town of Pine Knoll Shores and CAMA.
By way of this letter, I am requesting your permission to build a dock behind my property.
Said dock will conform with all necessary regulations and will be set back from, side neighbors
the required 15 feet.
Enclosed is an envelope to forward the signed letter to the Building Inspector, Pine Knoll
Shores.
