We have received the information submitted to this office in your inquiry con-
cerning the necessity of filing an application for a minor development permit
under the Coastal Area Management Act. The activity you propose is exempt
from needing a minor development permit providing it complies with the condi-
tions specified below. If your plans should change and your project will no
longer meet those conditions, please contact me before proceeding.
DESCRIPTION OF ACTIVITY AND CONDITIONS:
ACTIVITY: REPAIR AND REWIRING OF EXISTING DOCK.
(EXISTING DOCK - 161'LONG X 5"WIDE WITH "T" 16'X32#)
CONDITIONS: ALL WORK SHALL BE IN ACCORDANCE WITH SUBMITTED PLAT.
ALL WORK SHALL COMPLY WITH ALL FEDERAL, STATE AND LOCAL
REGULATIONS. BUILDING PERMITS ARE REQUIRED.
This certification of exemption from requiring a LAMA Permit is valid for
ninety (90) days from the date of issuance. Following expiration, a review of
the project and project site may be necessary to renew this certification.

Subject: George Leone Aquaculture Project
Dills Point Road / Otway, NC

Dear Mr. Bradley:
On May 31, 1995, I visited the subject project site along with George Leone and Marta Borris
(U.S. Army Corps of Engineers). Based on the site inspection it was determined that the area proposed
for constructing the holding tanks was not considered Section 404 wetlands and was not subject to the
Corps regulatory jurisdiction. I informed Mr. Leone that if total fish production remained under
100,000 lbs./year the facility would not meet the criteria contained in 40 CFR 122.24, Appendix C. for
determining a concentrated aquatic production facility. Therefor, an NPDES Permit would not be required
from this Division. unless production rates exceed this amount or if this Division determines that the
discharge from the facility poses a threat to the surface waters. Based on the May 31, 1995 meeting with
Mr. Leone, this Office would have no objection to the project as proposed. Should the production or
discharge rates change, it is recommended that this Office be contacted for further guidance.
