Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1. Asyr structure shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, ifmtu al shoreline recovery or beach nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so duet the structure is no longer imminently threatened, then it need not be relocated or dismantled at the time. This condition shall not affect the permit holders right to seek authorization oftemporary protective measure allowed under 7H .0308[a][2]. 2. Any building constructed within the Ocean Hazard Area shall comply with the North Carolina Building Code including the Coastal and Flood Plain Construction Standards, and the Pine Knoll Shares Flood Damage Prevention Ordinance as required by the National Flood bmwence Program Many provision of the building code or a flood damage prevention ordinance is inconsistent with nay of the AEC satadarda, the more restrictive provision shall control. 3. Any maintenance work or project modifications not covered under this permit requires further written permit approval. Round timber piles shall not be less than 8" in diameter, or square timber piles shall not be less than 8" square, nominal. All pilings within the Ocean Hazard Area shall have a tip penetration of at least 5.0' below mean sea level or 16' below average original grade whichever is least. The sills and joists of the lowest floor must meet the 100-year flood level elevation of 10' feet. 10. The structural accessway must not exceed six 0) feet in width. 11. The structural accessway must be raised on posts or pilings of 5' or less in depth so that only the vertical supports come in contact with the frontal dune. 12. Any areas of vegetation that are disturbed in the course of constricting the accessway must be revegetated as soon as feasible. 13. Robert J Sperberg District Engineer Dear Sir: The Board of Commissioners, Town of Pine Knoll Shores, by unanimous vote on 9 August, 1994, approved the attached resolution to emphasize its need for sand replenishment. Since the Town's inception in 1973, property owners along its 4 3/4 miles of south -facing beach have taken all possible measures to protect the dunes and natural terrain that exist along the ocean frontage. Set -back regulations and zoning res- trictions that exceed CAMA requirements, planting of vegetation, installation of sand fences and periodic sandpushing have helped to retard erosion. Unfortunately, this activity has not affected the depletion of the beach itself, caused by storm action, natural periodic washout and similar occurrences. The placement of dredged spoil from the Morehead City port area and the Intracoastal Waterway during the 1989-90 Corps project provided two separate sections of the Town's beachfront with a relatively small amount of material spread over approximately 2000 lineal feet of beach. The project that was completed this March, removing both stored spoil from Brandt Island and dredged material from the Morehead City Port harbor, was to have extended well into the eastern portion of Pine Knoll Shores. Due to unforeseen conditions, the sand placement stopped well within the Atlantic Beach boundaries. It is our understanding that based on available funding, another dredging operation will be scheduled in the next four years. Due to what we consider to be an extreme need, it is our request to be considered a prime recipient of any material available. Because of existing topography and town development patterns, there exist three possible areas where pipelines could cross the town from the sound to the ocean with a minimum of inconvenience, discharging directly onto the beach where buildup is sorely needed. Along with requiring special care by those who build and develop, the General Assembly directed the Coastal Resources Commission (CRC) to implement clear regula- tions which minimize the burden on the applicant. This application for a minor development permit under CAMA is part of the Commission's effort to meet the spirit and intent of the General Assembly. It has been designed to be straightforward and require no more time or effort necessary from the applicant. Please go over this folder with the Local Permit Officer (LPO) for the locality in which you plan to build to be certain that you understand what information he or she needs. Under CAMA regulations, the minor permit is to be issued within 25 days once a complete application is in j J�AU � hand. Often less time is needed if the project is simple. The process generally takes about 18 days. You can speed the approval process by making certain that your 6 05 �g application is complete and signed, that your drawing meets the specifications given inside and that your w - " application fee is attached. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Natural forces of water and wind collide with tons of force, even on calm days. Man-made structures cannot be guaranteed to survive the force of a hurricane. Long-term erosion (or barrier island migration) may take from two to ten feet of the beach each year and, sooner or later, will threaten oceanfront struc- tures. These are the facts of life for oceanfront property owners. The Coastal Resources Commission (CRC) has adopted rules for building along the oceanfront. The rules are in- tended to avoid an unreasonable risk to life and property and to limit public and private losses from storms and long-term erosion. These rules lessen but do not eliminate the element of risk in oceanfront development. As you consider building along the oceanfront, the CRC wants you to understand the rules and the risks. With this knowledge you can make a more informed decision about where and how to build in the coastal area. If the erosion rate is greater than 3.5 feet/year, the setback is 30 times the erosion rate plus 105 feet. The Reasons The beachfront is an ever -changing landform. The beach and the dunes are natural "shock absorbers", taking the beatings of the winds and waves and protecting the inland areas. By setting back 30 or 60 times the annual long-term erosion rate; you have a good chance of enjoying the full life of the structure. At first, it seems very inviting to build your dream house as close to the beach as possible, but in five years you could find the dream has become a nightmare as high tides and storm tides threaten your investment. The Exception The Coastal Resources Commission recognized that these rules, initially passed in June of 1979, might prove a hardship for some property owners. Therefore, they estab- lished an exception for lots which cannot meet the setback requirement. The exception alloivs buildings in front of the setback line if the following conditions apply: (1) the lot must have been platted as of June 1,1979, and not capable of being enlarged by combining with adjoining land under the same ownership, (2) development must be as far back on the property as possible and in no case less than 60 feet landward of the vegetation line, (3) no development can take place on the frontal dune (4) special construction standards on piling depth and square footage must be met and (5) all other CAMA, state and local regulations must be met. The exception is not available in the Inlet Hazard Area.
