activity located in the Town of Emerald Isle, Carteret
County.
Dear Mr, Banadyga:
The North Carolina Division of Coastal Management has reviewed the
above referenced application for a Nationwide Permit dated October
161 1993 pursuant to Section 307 of the Coastal Zone Management Act
of 1972 as amended. Based upon our review, we have determined that
the proposed activity is consistent with the North Carolina Coastal
Management Program provided the following conditions are met:
1. The activity described in the above referenced
application qualifies to receive one of the Nationwide
Permits described in 33 CFR part 330 with the exception
of Numbers 17, 21, 24, and 34 which were found inconsi.s�
tent with the North Carolina Coastal Management Program.

Army (DA) authorization to discharge fill material, into 3,700 square feet of
wetlands adjacent to Dog+te Sound to ccnstruct a Single family reaidencr� and a
driveway on your property at Let 15 on Canal Drive in the col,umbus Square
subdivision in Emerald Isle, Carteret County, North Carolina. Please note
that tide parmi.t authorizes only the discharge of fill imterial for "the pad
beneath the house and a one entrance drive on the e"t aide of the prooe2;ty•,
as specified in your forth Carolina Division of Mmvirommental xanagemaat *a►ter
Quality Certification, (D= Project # 93973), dated February 25, 1994,
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the
Clean Water Act, woo provided for discharges of dredged or fill material into
all waters of the United States provided:
a. The discharge does not exceed 29 cubic yards;
b. The discharge will not cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purpose$ of this nationwide
permit, the acreage limitation includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so that they Would no longer be a water of the United States as'a
result of the project;
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM) and, in the coastal area, a
consistency determination from the North Carolina Division of Coastal
Management (NCDCM), You should contact Mr. John borhey, telephone (919) 733-
1786, regarding crater quality certification, and Mr. Steve Huston, telephone
(919) 733-2293, regarding consistency determination. This nationwide permit
does not relieve you of the responsibility to obtain other required State or
local approval. '
This verification will be valid for two years from the date of thin
letter unless the nationwide authorization is modified, reissued or vav'oked.
Also, this verification will remain valid for the two years if, during that
period, the nationwide permit authorization is reissVed without modification
or the activity complies with any subsequent modifidAtiou of the nationwide
permit authorization. If during the two years, the nationwide permit
authorization expires or is euaperided or revoked, or is modified,, such that

the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which bane commenced (i.e., are under
construction)- or are under contract to commence in roliamce upon the

modification or revocation, unless discretionary authority has been exercised
on as cave -by -cans basis to modify, suspend or revoke the authorization.
