This permit action may be -appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. From the date of an appeal, any work conducted under this
permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit require further written permit approval.
All work must cease when this permit expires on
December 31. 1992
In issuing this permit it is agreed that this project is consis-
tent with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

REFERENCE: Denial of CAMA Minor Development Permit, #52-89
Gentlemen:
After reviewing your application in conjunction with the development
standards required by the Coastal Area Management Act (CAMA) and our
locally adopted land use plan and ordinances, it is my determination that
no permit may be granted for the project you have proposed.
This decision is based on my finding that your request violates N.C.G.S.
113A-120(8) which requires that all applications be denied which are
inconsistent with CAMA guidelines. You have applied to construct six (6)
duplex residential structures on 1.4 acres of land which is inconsistent -
with 15 N.C. A.C. 7H.0601 which states that:
No development shall be allowed in any AEC which would result
in a contravention or violation of any rules, regulations, or
Taws— of the State of North Carolina or of local government in
which the development takes place.
My conclusion is that your proposal violates the Town of Atlantic Beach
Subdivision regulations, chapter (4), section 9-4012. Design standards,
specifically the streets do not fulfill the requirement set forth
therein.
It is noted that the Town approved the original subdivision based upon
the findings that the project was exempt from the subdivision
regulations. The finding of facts was based upon the plot plan presented
to the Town indicating that the project met all the requirements set'
forth in the Subdivision regulations, section 9-4010(1)(d). However, the
plot plan submitted with the CAMA permit application does not meet these
requirements. Specifically, the street layout would require cross over
easements which is in reality a right-of-way dedication.
In view of the above, I have concluded that _your request violates
N.C.G.S. 113A-120(8) which also requires that all applications be denied
which are inconsistent with our local land use plan. On page 17 of the
Town of Atlantic Beach Land Use Plan, you will find that no dedication of
streets or other improvements may be accepted until the final plat is
approved. The final plat presented with your CAMA application reflects a
planned unit development (PUD) because it not only indicates right-of-way

dedications but other items inconsistent with individual lot development
such as seepage lines and the swimming pool crossing over lot lines. In
addition, -the plan does not show off-street parking.
Should you wish to appeal my decision to the Coastal Resources Commission
or request a variance from that group, please contact me so I can provide
you with the proper forms and any other information you may require.
Appeal notices must be received by the Division of Coastal Management in
Raleigh within 20 days of your receipt of this letter in order to be
considered.
Also, you may wish to appeal my interpretation of local ordinances and
regulations to the Board of Adjustment or request a variance from the
same. If so, please contact Joy Sasser regarding regulations governing
such appeals. Appeal notices must be received by this office within 30
days of receipt of this letter.

We have reviewed the information submitted'. to this office in your inquiry
concerning the necessity of filing an application for a minor development
permit under the Coastal Area Management Act. The activity you propose is
exempt from needinga minor development permit as long as it meets the
conditions specified below. If your plans should change and your project will
no longer meet those conditions, please contact me be fore proceeding.
DESCRIPTION OF ACTIVITY ARID CONDITIONS:
A private, non-commercial pier may be constructed if it does not exceed 200'
in total length offshore; is not within 150' of a federally maintained
channel, does not extend beyond the 4' mean low water contour line or normal
water level, (whichever is applicable) of the waterbody; does not exceed 6' in
width; does not include an enclosed structure; and, does not interfere with
established navigation rights. The 4' mean low water restriction shall not
-apply to piers constructed on man-made canals and basins. It may be built
through wetland vegetation only if elevated and may have a T-head or platform
not exceeding 500 square feet in area at its waterward end if no wetland areas
are covered. The pier must be set back a minimum of 15' from the adjacent
property owner's area of riparian access unless waived by a written agreement.
Confirmation must also be given that written statements have been obtained
from adjacent riparian property owners indicating that they have no objections
to. the proposed pier. The pier shall not extend beyond the established pier
length along the same shoreline for similar use, and in no case, extend more
than one-third (1/3) of the width of the waterbody and shall not interfere
with shellfish franchises or leases. Also, piers authorized by this exemption
shall be for the exclusive use of the landowner, and shall not provide either
leased or rented docking space or any other commercial services. Piers and
mooring facilities designed to provide docking space for more than four (4)
boats shall, because of their greater potential for adverse impacts, be
reviewed through the permitting process, and are, therefore, not authorized by
this exemption.
