in an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Mr. William Herbst, authorizing development in Estuarine Shoreline (AEC) at 147 Loblolly Dr. Pine Knoll
Shores NC 28512, adjacent to the Pine Knoll Waterway , as requested in the permit application, dated May 6, 2013.
This permit, issued on May 29, 2013 is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms
may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: The construction of a 12'x24' swimming pool with concrete apron.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on May 6, 2013.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 252-247-4353 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when'this permit expires on:
DECEMBER 31, 2016
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) The structure must not be water -ward of the 30' setback from MHL, as determined by the DCM, the LPO, or other
assigned agent of the DCM.
(6) The permittee is required to contact the Local Permit Officer 252-247-4353, shortly before he plans to begin
construction to arrange a setback measurement that will be effective for sixty (60) days barring a major shoreline
change. Construction must begin within sixty (60) days of the determination or the measurement is void and must
be redone.
(7) All buildings constructed within the AEC area shall comply with the NC Building Code, including the Coastal and
Flood Plain Construction Standards of the N. C. Building Code, and the Local Flood Damage Prevention Ordinance
as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage
prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive provision shall
control.
(8)AII unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted and
mulched) within 14 days of construction completion.

Southern Environmental Group, Inc. (SEGi) has been retained by Mr. William Herbst (herein referred to
as the "Applicant"), to secure a CAMA Minor Permit and Major Landscaping Permit, which will are
necessary for land disturbing activities within the 75' Estuarine Shoreline, Area of Environmental
Concern (AEC). The work is proposed to take place at 147 Loblolly Drive, in Pine Knoll Shores, North
Carolina, which serves as the main residence of the Applicant.
The site is 15,638 square feet (SF) in size and located on a man-made canal known as Pine Knoll
Waterway. Currently, a single family dwelling, with associated driveway, sidewalk and septic system exist
within the property boundaries. Normal high water is located on the waterward side of the existing
seawall, and there are no 404 or coastal wetlands present, within the property boundaries. Existing
impervious surface area (ISA), within the AEC is approximately 2,501 SR The Applicant wished to add
,350 SF of ISA, which would bring the total ISA within the 75' AEC to 2,501 SF or 24.5%. Total proposed
ISA for the property is 6,050 SF or 38.6% of the parcel.
The Applicant wishes to install a 12' x 24' swimming pool with a concrete apron. The work will consist of
the removal of several trees within the disturbance area, excavating approximately 675 SF of soil and
installing the pool and concrete surround. Approximately 350 SF of ISA is proposed with this project,
with less than 100 SF of patio pavers is proposed to be located within the 30' No Disturb Buffer. The
Applicant also intends to relocate an existing fence approximately 18' toward the front of the property. To
ensure that the proposed work is in accordance with the Town of Pine Knoll Shores landscaping
requirements, a Major Landscaping Permit has been included with this application. In order to expedite
the permit process, the Applicant directly contacted and obtained signed waivers for the proposed work
from the adjacent property owners.
It is my hope that the information found within and attached to this correspondence is sufficient to
complete the CAMA Minor Permit and Major Landscape Permit applications. However, if you find you
