in an area of environment concern pursuant to section 113A-118 of the
General Statutes, "Coastal Area Management'
Issued to Samuel F. Ballou, authorized agent for Jeffrey Hunt Brasfield, authorizing development in the Estuarine
Shoreline (AEC) at 169 Lands End Road, in Morehead City, Carteret County, North Carolina 28557, as requested in the
permittee's application, dated June 6, 2012, and revised on September 27, 2012. This permit, issued on September 28,
2012, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a
fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: the grading, filling, and seeding of the rear yard up to the 404 wetlands at the toe of the slope; the
construction of a fence down the slope on each side of the property and across the width of the property at the base of the
embankment; and the extension of the existing walkway with a four -foot -wide elevated, slatted, wooden walkway through the 404
wetlands, to the Normal High Water level.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings
dated received on June 6, 2012, and revised drawings dated received on September 27, 2012.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 252-726-6848 ext.125 for a final inspection
at completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days or the issuing date. From the date of an appeal, any
worts conducted under this permit must cease until the appeal Is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:
December 31, 2015
In issuing this permit it is agreed that this project is consistent with the local (_and
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) Unless specifically allowed in 15A NCAC 07H.0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of Normal High Water Level,
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Sedimentation and erosion control measures shall be properly
maintained throughout the construction period.
(7) The area proposed for grading must be contoured to prevent additional stormwater runoff to the adjacent marsh.
This area shall be immediately vegetatively stabilized and must remain in a vegetated state.
(8) This permit does not authorize the development of a berm within the 404 wetlands.
(9) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise
disposed of to a third -party.

Dear Mr, Brasfield and Mr. Ballou:
We have received the information needed from Amory Corps of Engineers (ACOE) Representative Christy
Wicker as to what can be approved through the CAMA Minor Permit Program. The 404 wetlands begin at the toe of
the slope and go towards the water known as Bogue Sound. Within that area, you can mow and seed without
obtaining a permit from the ALOE; however, if you want to fill the area with any material (gravel, dirt, sod, etc.), you
will need a permit from the ACOE (this includes creating a berm), Should you need to apply for a permit from the
ACOE, we will not be able to issue you a CAMA Minor Permit. You would be required to apply to the Division of
Coastal Management, 400 Commerce Avenue, Morehead City, NC 28557, 252-808-2808, for a LAMA General
Permit, If you choose to mow and seed only, our office can process the LAMA Minor Permit Application you already
submitted.
In regards to the extension of the walkway, pile -supported structures are allowed within the 404 wetlands
and do not need a permit from the ACOE. Our office can process the LAMA Minor Permit Application you already
submitted for the elevated, wooden walkway.
If you wish to proceed with the CAMA Minor Permit Application process, our office will need a revised site
plan, to scale, showing the following:
1. The Normal High Water (NHW) lime;
2. The 30' Buffer line;
3. The 404 wetlands line at the toe of the hill; and
4. The placement of the elevated, wooden walkway.
Upon receipt of the required information, a local decision will be made within 25 days. If you have any

Per our phone conversation, pile supported structures within the wetland do not require a
permit from our office as long as they do not create a shading effect. However, if they were
to construct a pile supported struction within the AEC, coastal wetlands or Bogue sound they
would need to contact the NC Division of Coastal Management.

Good Morning Dean,
169 Lands End Road's wetlands began at the toe of the slope. within this area they can mow
and seed without a permit but once they start bring in the fill (gravel, dirt, sod, etc.) or
disturbing the soil then they will need to apply for a permit.
We generally do not issue permits for aesthetics or to extend yards. I did a historical
aerial search of the site next door and those wetlands were filled before 2006 which is too
far back for our office to pursue.
