White, Ill., authorizing development in the Estuarine Shoreline (AEC) at 216 Bayview Blvd., in Atlantic Beach, N.C., as requested in the permittee's application, dated May 7, 2007. This permit, issued on May 24, 2007, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and -special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. _ _This permit authorizes the installation of a fence in the canal side yard located 17' from the normal high water mark. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawing received on May 11, 2007. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4). A copy of this permit shall be posted or available on site. Contact this office at (252) 726-4456 for a final inspection at completion of work.. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2010 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. Box 10 Atlantic Beach, NC 28512 Re: Application for Permit to Erect Pickett Fence Partially Within CAMA Area Dear Ms. Turner: want to build a small picket fence off the East end of my home to safely contain grandchildren and my bird dog and to keep stray dogs out of the play area. Because of the slanted shoreline, part of my fence will be in the CAMA area, as it will be parallel to our home rather than the bulkhead for aesthetic reasons. This is shown on the diagram with my application. I discussed this with Ryan Davenport at CAMA, and he told me that because this is a minor project not impacting the estuarine and not construction of a building in the CAMA area or a pier or seawall affecting riparian rights, the application is to be made to you as CAMA's Agent for such purposes. Enclosed is my application on the form provided me by your assistant, as well as the CAMA Application, and my check in amount of $100 as the permit fee. I have sent, by certified mail, notification to my adjoining neighbors and am enclosing copies of the mailing envelope and the notice and drawing of the proposed picket fence included. You will recall that both neighbors (Flowers and Sipp) sought unjustifiably to interfere with and stop the recent construction of our home. I hope that this willIc-o—n-d-u—ciiihot be repeated. It so happens that the fence we will be installing will be identical (unless we use vinyl) to that on the Sipps' property next to us on the South; which also is in the CAMA Area. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one onto your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be notified.
