Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. 1) The permittee is required to contact Local Permit Officer shortly before he plans to begin construction to arrange a setback measurement which will be effective or sixty (60) days barring a major shoreline change. Construction must begin within sixty (60) days of the determination or the measurement is void and must be redc rie. 2) Any structure within the Ocean Hazard AEC shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. Th structure(s) shall be relocated or dismantled within two years of the time when it becomes imminently threatened, and in any case upon its collapse or subsidence. However, if natural shoreline recovery or beach Rrnourishment takes place within two years of the time the structure becomes imminently threatened so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to see authorization of temporary protective measures allowed under the Coastal Resources Commission Rules. 3) In order to avoid unreasonable danger to life and property, all development shall be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm. Cantilevered decks and walkways shall meet this standard or shall be designed to break -away without structural dar tage to the main structure. Any building constructed within the ocean hazard area shall comply with the North Carolina Building Code including the Coastal and Flood 31air Construction Standards, Chapter 34, Volume I or Section 39, Volume 1-B and the local flood damage prevention ordinance as required by the National Flood Insur. nce Program. If any provisions of the building code or a flood damage prevention ordinance is inconsistent with any of the AEC standards, the more restrictive provisio shall control. 4) The structure must be set back 60 feet from the first line of stable, natural vegetation. Decline not to exceed 500 square feet total. 5) The structure must be located entirely off the frontal dune, and, if a primary dune is present, behind the crest of the primary dune. 6) The structure must be elevated on pilings with a diameter of at least eight (8) inches and the first floor level of the sills and joists must meet the minimal 100 yea flood as required by FIRM Community Panel tD-2m.0"- J. 7) All pilings shall have a tip penetration of at least five (5) feet below mean sea level, or sixteen (16) feet below average original grade, whichever is least; if locatt d on a primary dune, the tip penetration must be at least five (5) feet below mean sea level. 8) No impermeable surfaces shall be allowed over any functional part of the septic tank system. 9) Dune disturbances will be allowed only to the extent necessary for development, and if the dune's protective value is not weakened or reduced. Disturbed areas 1A ill be immediately stabilized. 10) This permit may be renewed for one year, if requested before the expiration date. 11) Sand used to strengthen dunes must be brought in from an outside source and must be of the same nature as the sand in the area in which it is to be placed. Additional Permit required from district office No sand is to be removed from the Property. 12) Sand held in storage in any dune other than frontal or primary dunes may be moved laterally in order to strengthen existing primary or frontal dunes if the wor would enhance the protection to the proposed development activity and the sand is immediately stabilized. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this per- mit m„st cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modifications not covered under this permit requires further written permit approval. Accessways shall be exclusively for pedestrian use, shall be no more than six(6) feet wide, and shall be elevated on pilings of no more than five (5) feet in depth so that only the pilings touch the sand. 2. Only negligible alteration of dunes is allowed during construction and any disturbed areas of vegetation shall be revegetated immediately. 3. Unenclosed, uninhabitable gazebos with floor areas of 200 square feet or less, are permitted. SPECIAL NOTES: Driveway to be limited to 16' width at street. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules onbuilding standards, oceanfront setbacks and dune alterationare designed to minimize,but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual ocean erosion rate for the area where your property is located is J_ feet per year. The rate was established by careful analysis of aeri.5� 1 photographs of the coastline taken over the past 50 year Studies also indicate that the shoreline could move as much as =4 feet landward in a major storm. The floodwaters in amajor storm are predicted to be about feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary devices, including sand bags, may be allowed under certain conditions. This structure shall be relocated or dismantled within two years of becoming imminently threatened. The applicant must acknowledge this information and requirements by signing this notice in the below space. Without the proper signature, the application will not be complete. Date SPECIAL NOTE: This hazard notice is required for development in areas subject to sudden and massive storms and erosion. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer will determine the vegetation line and setback distance at your site. If thepropertyhas seenlittle change and theproposed development can still meet the setback requirement, the LPO will inform you that you may begin work. It is impor- tant that you check with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal may not be necessary.
