HomeMy WebLinkAbout05-09_Harvin Family Farms, LLC._20051128Town of Emerald Isle Local Government 05.99 Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management" Issued to Harvin Family Farms, LLC, authorizing development in the Estuarine Shoreline - ORW (AEC) at 7522 Sound Drive in Emerald Isle, as requested in the permittee's application, dated November 11, 2005. This permit, issued on November 28, 2005, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Install a driveway (1) All proposed development and associated construction must be .done in accordance with the permitted work plat drawings(s) dated received on November 11, 2005. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at 252-354-3338 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: DECEMBER 31, 2008 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. This permit may not be transferred to another party without the written approval of the Division of Coastal Management. James W. (6) Unless specifically allowed in 15A NCAC O7H. 0209(d)(10), and shown on the permitted plan drawing, all development/construction shall be located a distance of 30 feet landward of Normal High Water Line. No portion of the roof overhang shall encroach into the 30 ft. buffer. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) Any proposed for grading within the 30' buffer from the Normal High Water Line must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. (10) No filling of coastal or 401 wetlands authorized under permit. (11)Temporary silt fencing will be required to protect 30' buffer from development activity. Possible permanent retaining wall may be required. Applicant to indicate placement of fencing. (12)No land disturbing activity permitted in buffer or wetlands. 03)Stomnwater run-off from driveway shall not be directly discharged into wetlands. The road will be temporary to allow seawall construction access, and I plan to restore the land as much as feasible to the original condition upon completion of the project. Size of lot #4 Maritime Forest (7522 Sound Drive) —Approximately 282.2 feet deep by 75 feet wide Area of lot: 21165 square feet 25% Maximum Allowed Coverage: 5291 square feet Dimensions of road 14 feet wide by 250 feet long (road does not go full length of lot — only far enough to access the shoreline). The road will be placed approximately 15 feet to the west of a centerline through the lot, and will attempt to avoid major trees. Area of Proposed road: 3500 square feet Area Percentage of Road as compared to total lot: 16.5% This does not exceed the allowed coverage area and is therefore in compliance.
