I immediately contacted Ms. Terre Barrett with the regional Coastal Area Management Agency (LAMA) in Morehead City ab6ut this issue. Ms. Barrett has agreed that there are violations to the 30' buffered area requirement in this park and cannot continue. Your mobile can be placed as indicated on the application and accessory structures landward of the 30' buffer required. Therefore, your application must be revised before it can be processed to remove any decking that will encroach into the 30' buffer area. Please make these revisions and submit to this office to get this permit back on track. The application has not yet been advertised and therefore will not be processed until your next submittal. The application can be processed through this office as soon as this revision is received and verified. Management Agency (CAMA), hereby gives NOTICE that on April 19, 2004, Mark Suhrie, 338 Watersedge MHP, Lot 20 has applied to construct decking landward of the 30' buffer area within the area of environmental concern. The application may be inspected at the address below. Public comments received by May 3, 2004 will be considered. Later comments will be accepted and considered up to the time of permit decision. Project modifications may occur based on further review and comments. Notice of the permit decision in this matter will be issued upon written request. James W. Taylor Local CAMA Permit Officer Town of Emerald Isle 7500 Emerald Drive Emerald Isle, NC 28594 252/354/3338 (1) The accessway must not exceed six feet in width and must be for private residential or for public access to an ocean beach. This exemption does not apply to accessways for commercial use or for motor -powered vehicular use. (2) The accessway must be constructed so as to make no alterations to the frontal dunes that are not necessary to construct the accessway. This means that wherever possible the accessway must be constructed over the frontal dune wi;'aout any alteration of the dunes. In no case shall the dune be altered so as to significantly ' diminish its capacity as a protective barrier against flooding and erosion. Driving of pilings into the dune shall not be considered alteration of a frontal dune for the purposes of this Rule. (3) The accessway shall conform with any applicable local or state building code standards. (b) Before beginning any work under this exemption the CAMA local permit officer or Department of Environment, Health, and Natural Resources representative must be notified of the proposed activity to allow on -site review of the proposed accessway- Notification can be by telephone, in person. or in writing and must include: (I) name, address, and telephone number of landowner and location of work including county and nearest community; (2) the dimensions of the proposed structural accessway. December 1,1991; May 1, 1990. 15A NCAC 07K .0208 SINGLE FAMILY RESIDENCES EXEMPTED (a) All single family residences c, tistructed within the Estuarine Shoreline Area of Environmental Concern which are more than or normal water level, and involve no land disturbing activity within the 40 feet 40 feet landward of the mean high water mark t as long as this exemption is consistent with all other applicable buffer area are exempted from the CAMA permit requiremen CAMA permit standards and local land use plans and/or rules in effect at the time the exemption is granted. This exemption does allow for the construction of an access to the water not exceeding six feet in width. i (b) Within the AEC for estuarine shorelines contiguous to waters classified as Outstanding Resource Waters (ORW), no CAMA permit will be required if the proposed development is a single-family residence which has a built upon area of 25 percentor less and: (1) has no stormwater collection system; and (2) is at least 40 feet from waters classified as ORW. (c) Before beginning _any work under this exemption, the Department of Environment, Health, and Natural Resources representative must be notified of the proposed activity to allow on -site review. Notification may be by telephone, in person or in writing. Notification must include: (1) the name, address, and telephone number of the landowner and the location of the work, including the county, nearest community and water body; (2) the dimensions of the proposed pier, bulkhead with backfill or the area dimensions to be covered by Placement of riprap, material; (3) confirmation that a written statement has been obtained, signed by the adjacent riparian property owners indicating that; -iey have no objections to the proposed work. (These statements do not have to be presented at the time of notification of intent to perform work, but the permittee must make it available to CRC agents at their request.) (d) In eroding areas, this exemption shall apply only when, in the opinion of the local permit officer, the house has been located the maximum feasible distance back on the lot but not less than forty feet.
