in an area of environmental concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management."

This permit, issued on 2/03/04 is subject to compliance with the application and site drawing (where consistent
with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.

Permit Number
This is a permit authorizing the minor grading and redistribution of sand above the mean high water
mark and waterward of the seawall located at 700 E. Fort Macon Rd. Any other development will
require additional permits or a modification of this permit. The following conditions shall apply:
The area on which this activity is being performed must maintain a slope of adequate grade so as not to
endanger the public or the public's use of the beach, and should follow the natural slope as closely as
possible. The movement of material utilizing a bulldozer, front-end loader, backhoe, scraper, or any type of
earth moving equipmentshall not exceed one (1) foot in depth measured from the pre -activity surface
elevation.
The activity must not exceed the lateral bounds of the applicant's property unless he has permission of
adjoining landowners. The applicant must contact the local permitting officer. before starting work.
The activity must not significantly increase erosion on neighboring properties and must not have a•
significant adverse effect on important or cultural resources.
Movement of material from seaward of the low water line will not be permitted. No vegetation disturbance is
allowed.
In order to minimize adverse impacts to nesting sea turtles, no work shall occur within the period May 1
through November 15, of any year without prior consultation by the Division of Coastal Management.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. f J

Dear Mr. Cooper:
The N.C. Division of Coastal Management hereby acknowledges receipt of your application for
State approval for minor development of your property located at 700 E. Fort Macon Rd., Atlantic
Beach in Carteret County. It was received complete on January 20, 2004 and appears to be
adequate for processing at this time. The deadline for making a permit decision is February 14,
2004.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be notified.

NOTICE OF FILING AN APPLICATION FOR
CAMA MINOR DEVELOPMENT PERMIT
Pursuant to NCGS 113A-119(b), the Town of Atlantic Beach, a locality authorized to issue
CAMA Permits in areas of environmental concern, hereby gives notice that on January 20,
2004, the Oceanana Resort, LLC applied for a CAMA Permit for minor grading and
redistribution of sand in front of the their seawall located at 700 E. Fort Macon Rd. in
Atlantic Beach, NC. The application may be inspected at the address below. Public
comments received by February 2, 2004 will be considered. Later comments will be
accepted and considered up to the time of permit decision. Project modifications may
occur based on further review and comments. Notice of the permit decision in this matter
will be provided upon written request.
